    Just heard that TC are going to defend my claim against them for a 32 hour delay from Manchester to Vegas November TCX124 10th last year, had the run around from them, CAA (Clowns) for several months before we issued the file via MCOL. The flight delay was because of a technical issue then followed on by a change in flight plan ( or as i beleive our plane was sent down to Cuba with passengers who had been delayed the day before) Flight Stats come up with details that the flight was "CANCELLED" Any other place to get more info please
    The bottom line is TC have a shocking record for punctuality according to www.flightinfo.info last summer if you had booked a return flight with TC you had a 1 in 17 chance of having a substantial delay of more than 3 hours. This was a significant increase on the previous year. As EC 261/2004 among other things was supposed to improve airline reliability, it certainly hasn't in this case. There are obvious faults in the way TC manage their fleet, due to reorganisation after their financial problems of early 2012. However if they want to cut staff levels, and flog their fleet to death they should be prepared to accept the liabilities such an operating model produces, which they obviously are not. As their 3 hour delays are about 6 times more than say Thomson who operate similar aircraft, its not bad luck. After reading the posts on this thread for the past twelve months I will leave you to guess what my thoughts on the safety of their aircraft are

    Just reading this but I managed to do MCOL for a delayed flight Belfast to Orlando on 10-08-07 and TC paid out last week 3 days before 6 year deadline and before it went to court on 03.08,13

    Just thought I would post this while I was putting my case together, TC delays in term and conditions state it abides by the EC ruling for delays if it does not them you can also tell the court that no matter what is is a breach of contract for fare paying passengers. No excuses.

    I could not agree with you more - I plotted JUST the flights we were delayed on over a period of 6 weeks and every week every flight was delayed over 3 hours! And remember this is just two flights per week from their schedule. It seems very clear to me that they just could not cope at that time, having sold off the family silver to get a bit of money in but forgetting they still had obligations to fulfil. I really want to use this as part of my argument when we eventually get into court later this year - any thoughts?

    - Researched small claims court website ( printed off Form1B ready to send / start legal proceedings)


    I feel ive put a little effort into this claim for compensation so far.
    Have I missed anything that other people have done?.

    Im not expecting it to be "just be given to me on a plate"

    I had a 6hour delay from Mahon to Manchester in 2009. 4 adults in the party and 1 infant. Wrote to TC's with the template letter and after 2 months they sent me vouchers for £1500. Rung them up to say I want cash, they didn't argue, I got the cheque about a week later. Cheque now cashed. Happy Days!
  • What an absolute shower TC are. I called the customer relations team after all my written requests for information have been ignored. It was ridiculous. The person I spoke to was hopeless but I did find out a couple of interesting things. The 'thorough investigation' that was carried out to investigate my claim involved someone checking a spreadsheet that has been provided by the airline. She admitted to me that she didn't understand what she was reading, too technical for her.

  • Well at last I am VERY happy to report that Thomas Cook have seen sense and have sent a cheque for the full amount of £1388 and no word about returning their useless voucher. I bet if I tried to use it, it would turn out to be not valid.

    Well it a big thank you for all the advice and help on this forum, without it I might have given up ages ago.

    Keep battling on the rest of you it can be done.

    Recd cheque for full amount on Saturday and banked it this morning

    Lets hope the !!!!!!s don't go bang in the next 4 days.
