Ok - so make sure you start court action before you are timed out (assuming you don't want to just drop it?)0 -
no not going to drop it as we were delayed for over 5 hours and I was 5 months pregnant at the time we were not given anything no drinks food nothing I also had our other children ages at the time 2, 7 and 9 who were totally stressed .0

I would forget a reply to your NBA letter, they are not going to answer before then.0 -
TC has now confirmed delay was due to blocked toilets on incoming flight, but still maintains it is EC as it 'could not have been foreseen or forestalled'. They are quoting Recitals 14 & 15 of the Preamble to EC Reg 261/2004 as their defence. They have confirmed they will not be making an offer of compensation. I maintain blocked toilets are not an EC but a technical/maintenance issue which they should have the staff and tools to sort out in a timely manner, not the seven hours they took to decide they couldn't fix it then wait another 5 hours for them to send an aircraft from Manchester to collect the inbound passengers then to Fuerteventura to collect us for the return leg! I have also pointed out as per advice on Watchdog that they cannot claim EC as the blocked toilet didn't affect our actual flight TCX 7029, but the inbound flight TCX 7028. Are they being awkward here or am I missing something?0

You are absolutely spot on. Not ECs. There defence is, quite literally, a pile of poo.0 -
Hi there,
Im a little new to the game here, and would like to pick your collective brains.
Myself and her indoors were delayed by 5 and a half hours flying out from Manchester to Reus aiport on flight TCX2336 on 30th September 2012 . We were also delayed 3 and a half hours on the return journey.
My question is how much in total can i claim for in compensation. The flight distance is 1380km in either direction.
Im about to fire off the LBA so any help with this would be greatly appreciated.
Thanks !0 -
Without having to read through 116 (?) pages of posts has anyone been successful in getting compensation from Thomas Cook for delays? I sent in my claim and got the standard letter shown on page 1 of this thread stating that I should've claimed within 28 days of my holiday! My holiday was in July 2009. What do you do next? Thanks to anyone who replies0

Read the Stickies at the top of this section of the forum all the info is there.
Yep cheers . I've looked through them and im still a little bit confused. The return leg seems straightforward, 3.5 hour delay = 250 euro pp.
Is the outbound 5.5 hour delay = 600 euro or total cost of flight?0 -
This is Tc reply to the court I have already started court action0
