MON4362 Manchester to Sharm El Sheikh on 23rd April 2011Claim denied due to extraordinary circumstances.
The flight suffered a brake unit failure.

Success with Monarch ZB 336, Calgary to Gatwick, 5 April 2008. Had to go through the usual letters, eventual form filling once Monarch responded, then no further response from Monarch, gave them 2 months to pay in full, had to submit Small Claims Court proceedings, but this bore results within the week. Monarch will also pay the Small Claims fee. Received the full Euro 600 each. We were out of pocket by about £700 each. In short, I suspect Monarch will not pay out until they have received a summons to the Small Claims Court. Many thanks to Martin, even though he's moved on.
Well done. Shows that the only way to get results is to follow through on the Court process.
Can you explain what Monarch claimed/you understood the problem to be?0 -

You can add on to your list the above flight MAN to MXP on the 14th June 2012. No claim due to the EC reasons given:
Technical problems within the Monarch fleet and the peak season time of year. Insufficient aircraft to operate the flight on time.
Maybe i'm reading too much into this flight, as we had to fly to LGW to go and collect their passengers en-route to MXP. Although it was the same size aircraft that was scheduled to fly this route the same size aircraft that was now unsafe to fly turned up at MAN with only half a load boarded at MAN and then collected from LGW and the flight still wasn't full. Also, Monarch have pulled this route from MAN as it was a "low revenue" flight.
Coincedence?
I will take this up with the CAA and see what they say.
p.s. to get this this far it has taken approx 14weeks.
Check my post#786 re-flight ZB1377 Venice-Man via LGW also on 14/6/2012. This arrived Man. at 17.06 hrs. (4 hrs. Late)
I note from flightstats website that your flight left Man. at 18.13hrs. (4 hrs. 3mins. late) which strongly suggests it was the same plane we landed on.
The fact that both flights went via LGW combining 2 less than half full flights between the UK and Italy increases my concern that Monarch are possibly being economic with the truth in the interests of commercial advantage?? Or perhaps I'm being a bit harsh?
I'm not really sure of the significance of this info. And how it can be used to the best advantage.0 -

Good news! Email from Monarch today saying they will pay compensation. Bad news! Only at 50%. I am fairly sure that they are still trying it on as I always felt that I had A rock solid case for full compensation. I have looked through the FAQs but can find no reference to the reasons why they can reduce compo other than the fact that they may have re-routed me, which did not happen and also that they made reference to a reduction on their clam form. My situation was a delay between 3 and 4 hours on a flight of 1500k. I will inform of full details when I get this sorted out. But in the meantime any comments or thoughts?0 -

That's right I'm afraid: a delay of between 3 and 4 hours means 50% of the compensation only over that distance:
3,500km+, eg, London to New York3-4 hours€300 (£259)4+ hours€600 (£515)
Did you initiate court proceedings? If so how far did you get?0 -

Flight ZB1377 Vencie - Manchester 21/06/2013
Flight delayed by 8hrs, our flight was merged with Milan flight, so we had to drop off and pick up at Milan before flying to Manchester. They have rejected our claim as the aircraft due to operate our flight was declared unserviceable due to suffering an integrated drive generator leak that rendered it unsafe to fly and the same aircraft was was due to operate from Milan to Manchester on the same day. Ironically on the way out to Venice from Manchester we had to stop off at gatwick to pick up passengers seems Monarch are definitely merging flights when only half full.0 -

They gave me the same reason for my flight ZB661 from Malaga to Manchester on 8th July 2012. What was the date of your flight?0 -
