This thread will enlighten you if you read it through. Over 99% of the posters are in the same boat as you.
The tech issue Monarch are quoting is not an extraordinary circumstance.
Read the FAQ's sticky.
You now need to write them a NBA (template in the FAQ's) and give them 14 days notice of court action, and then file a claim through MCOL (if you are in England).0 -
Does it make any difference if my refused compensation claim response wasnt signed at all. It was just from the Monarch claims team???0

We suffered a 10 hour delay at Luton on July 30 2011 (Monarch ZB870 Luton to Palma). In October after the cour ruling, I submitted a claim. I then completed Monarch's very tatty claim form and supplied original documents - including passports. By December nothing had happened. I wrote again and they replied to say they needed to check with "third parties". Nothing happened. I contacted the CAA who forwarded on my complaint to Monarch earlier this week.
Yesterday Monarch responded to throw out our claim - said they had technical problems in their fleet and didn't have sufficient aircraft available.
Does this sound like a legally acceptable get-out?
Anyone else suffer problems on that flight - on the day we were told at the airport that Monarch had delays for several days that week because of a problem with an aircraft. Other passengers reckoned the same flight on the same day the previous year had also been delayed for 10 hours!0 -
Success with Monarch ZB 336, Calgary to Gatwick, 5 April 2008. Had to go through the usual letters, eventual form filling once Monarch responded, then no further response from Monarch, gave them 2 months to pay in full, had to submit Small Claims Court proceedings, but this bore results within the week. Monarch will also pay the Small Claims fee. Received the full Euro 600 each. We were out of pocket by about £700 each. In short, I suspect Monarch will not pay out until they have received a summons to the Small Claims Court. Many thanks to Martin, even though he's moved on.0

I did start adding in brackets the number of the post where the fault/EC denial was posted, which I'd done that from the off now :cool:

There seem to be two different reasons:-
1 Previous Sharm flight wing damage Knock on EC (as reported on your list)
2 Rudder defect (Monarch's reason to me)
I was hoping to liaise with the poster who was given the 'wing damage' reason if you know the post
