    The flight was delayed by 8 hours and upon arrival at Gatwick we were given a letter stating that the delay was caused by a "technical fault".

    Off to the courts next.

    I too was on this flight and recieved the same reply today, 4 times. They seem to be suggesting that it was our flight that was delayed but as I recall, it was the flight coming in that was delayed.

    Yes, I'm trying to group all the windscreen claim one's together, following Monarchs claim that they had 'only' two last year, to see if they get two or more every year, then it's not an EC something that happens every year?

    I've just had Monarch's refusal letter re this outbound flight ZB532 and they claim it was EC in that the aircraft developed rudder problems and that they transferred passengers to the first available aircraft (it was >5hour delay).

    Rudder problems have also been given by them for the reasons they've given for the delayed inbound flight 533.

    Where did you get the info about it being wing damage on a previous Sharm flight please?

    I'm assuming I write to ask for the technical report now?

    Basically I'm just adding to the OP list as EC refusal letters are placed on the thread. I'm also grouping them together if I find similar faults so there's no date order to the list.
    I did start adding in brackets the number of the post where the fault/EC denial was posted, which I'd done that from the off now :cool:
    Also some posts have been made in other threads, which I've added to this threads OP, not many though.

    Hello All

    I was on flight MON349 Gatwick to Sanford Airport Florida on 30/07/2009. This flight was subject (as I recall)to a 5 hour delay. I have today received written correspondence from Monarch who have not accepted our claim. They state as follows:
    "Our records show that the aircraft originally scheduled to operate your flight became unserviceable after suffering a fault with the Ground Power Control Unit. Despite our best efforts this led to a delay in the scheduled departure time of your flight. In order to reduce the length of your delay and minimise the disruption caused, passengers on your flight were transferred to the first available aircraft from within our fleet. Having considered the factual background of this incident, we are satisfied that the disruption in your case was caused by an extraordinary circumstance that could not have reasonably been prevented by Monarch Airlines. We are, therefore, unable to accept your claim for compensation for the reasons given".

    Can anyone clarify if their reasons stated fall within extraordinary circumstances? If not should we pursue this and any ideas on next letter wording?

    Not EC, and they changed the plane. Next letter, use NBA, find that in the FAQ's sticky.

    After waiting 6 weeks for a reply to my letter, I finally get an e-mail today asking me to fill out their claim forms. Playing for time, obviously.

    No matter. I can wait

    NO! If you initially wrote them a letter with all the details, NOW write to them giving them 14 days notice to settle or you'll start a court claim. The template letter for this is in the FAQ's sticky.
    You'll be dangling on a string for months on end otherwise.
    It's perfectly reasonable to claim using a regular letter with all the details, and perfectly reasonable to expect a reply within 14 days.
    You have had neither.
    You WILL be going to court. Take that on board.
  • We have had a similar experience with a flight from Malaga to Birmingham in Sept 2012 and have been refused by Monarch. They state that the Plane had experienced a problem arriving in Palma?? relevance with the starter motor.
    My problem with the term "extraordinary circumstances" is how it could be open to interpretation and abuse.

    The airline left a message on my answerphone at HOME approx 2/3 days before my flight was due to fly back. Obvioulsy as we were away we never received the call and my issue is surely they had time to repair the sadi Plane or arrange alternatives for the original designated time!!

    Your help and advice would be most appreciated as to whether to persue as I think that I am being fobbed off. Many thanks
