Download and read Vaubans excellent guide and then send Monarch a Letter Before Action all explained in the guide. You have what they call in basketball a slam dunk case. €600 per passanger. Can you put this on the Monarch Thread0

Hi all.
Wondering how many people have had this with Monarch and what they've done about it. We were delayed 2 years ago over 5 hours. We duly filled out paperwork immediately and sent it in. Monarch declined the request, so we appealed and they declined again. I've just this week received a letter from AESA - spanish equivalent of our regulatory body here and they think that we should have received the compensation. We are looking at 400 Euros per person and there were 5 passengers.
This is the reply from Monarch this morning:
"Thank you for your correspondence.
I have noted that AESA have responded to you recommending that we settle your claim for compensation. For your reference when contact is made with us from a National Enforcement Body we will furnish them with the reasons for the delay and provide documentary evidence to support our decision should we deem that extraordinary circumstances were the cause.
As I am sure you can appreciate compensation payments cannot be enforced by the said regulatory body. I can confirm that our legal team remain satisfied that your delay was the result of extraordinary circumstances therefore I must respectfully decline your request for compensation in accordance with EC261/2004.
We do realise that this decision may provoke you to take further action which you, of course, reserve the right to do."
Has anyone else done this on their own? how did you fair and what steps did you take?

I've never claimed from them, but some friends have. They had no problems getting paid.0

I am finally preparing my NBA. My delay was due to 'knock-on'. How much detail do I need to write in the NBA? Do I need to quote previous relevant cases at this stage? Do I need to state my reasons for rejecting their claim of 'extraordinary circumstances'? Can I send it by email or should I mail it? Many thanks in advance.0

Just need to inform them you intend taking action within 14 days. With Monarch I would send by email but also send the letter by post (proof of posting from PO sufficient - recorded/registered not required) - no need to give any further details at this stage.0
