Hi, I've just had my claim rejected by Monarch for a 21hour flight delay. I'd appreciate any views/advice please?

The reason to reject is 'aircraft scheduled to operate your flight suffered a technical fault immediately prior to its previous flight rotation'

They then go on to say that a part had failed that was only 5 months old, so they deem it as a manufacturing defect and therefore could not have reasonably been prevented by Monarch.

I can't help but feel that my claim is valid and they are just trying to fob me off.

Was this the manchester to sharm on 13/7/14 by any chance, just recieved the same thing myself.

Perhaps let Airbus and Boeing know about this, so they can clarify things with Monarch.

I was on it too and got the same response. Are you taking it further?

You (and Adam3885 and Steventa) are all owed €600 per passenger by law. Though Monarch don't want to pay, and are spinning you a story to make you go away, the Supreme Court is clear you're owed compensation in these circumstances.

However, you are going to have to fight to get your money. Either by employing a NWNF solicitor (who'll take about €200 per passenger) or by doing it yourself. Which involves some effort - but is far from impossible for most people.

Don't be tempted to think that if one person goes first and gets paid out that this means you will too. The airlines fight each and every case separately.

Read my guide if you want the money that's owed to you.

Has anyone had a successful claim against Monarch.
Departed 10th June 2012 from Manchester airport to share el sheik .
    6 hours delay.

Hi, Ive got a claim against them for the MON3727 flight from Sharm to Manchester on the 10/06/12 - pretty sure they will be due to the same issue. I've been fighting it for 2.5yrs & still ongoing :)

There's a very good Facebook page where you can read more about Monarch and their non-payouts...

  • Yes I do see your point, but how far do you take the argument isn't bad weather to be expected and inherent in the airlines business, you could use the same argument about all the reasons of an EC.

My argument is that bad weather is specifically mentioned in the regs as an EC (for the flight concerned) but bird strikes are not mentioned anywhere.
It's how you interpret the actual EC261 regs, and the basic generally accepted understanding of them, it would be interesting to know if anybody has successfully received compensation due to a delay caused by a bird strike, I don't recall reading of any on here.
