Okay, got a cheque at last but short my warrant fee. The date on the covering letter and the date on the cheque are 4 weeks apart so I guess the Finance in-tray is pretty full. Not sure I'll chase the warrant fee; just had enough of this ****. Will clear the cheque before dismissing my claim though.:p

Many thanks to 111KAB, JPears and Vauban for their brilliant support.

The fact that they have already paid out on this flight will cut no ice with Monarch. All you can do is to take them to court. Like your friend did.

Further down the line, getting a signed affidavit from your friend, to present at court, that they have paid out on this exact same flight will help your case.

    Hi All
I've filled in their forms, sent all the docs, boarding cards etc and they just decline my claim and ignore the chasing.

our inbound aircraft was delayed getting to us due to:

    1. Tec wheel/ brake issue at Manchester before it left to collect us
    2. Late arriving at Manchester due to diverting to France (heart Attack on board) on it's Faro - Manchester sector

This is 2 sectors prior to our flight from Antalya to Manchester

Does anyone know if they are paying out on ZB521 31 May 2014 Antalya to Manchester

    Many thanks

    Steve

    Steve

Well they're not paying out for you - and that's the only thing that matters. (The airlines don't feel obliged to pay out to others just because they've paid someone else on the flight.)

So all you can reasonably do is start a legal case if you think you have a claim. The heart attack would be considered extraordinary - but not on two legs preceding your flight! The tech problem is not extraordinary. So I think you have a clear claim.

My guide will tell you what you need to do.

    Thanks Vauban

I need to claim for me, Mrs + 2 kids. Can I do this on the one N1 form? and take to local court or post to Northampton?

Yes you can. N1 form. Local court. But don't forget to send your NBA first!
  • Here's a good one! I've been fighting Monarch for 2 years! They sent me correspondence explaining why they felt the technical problem (a stiff throttle lever) was an EC.

I decided to hand the case over to a NWNF company who issued court proceedings. Monarch have now tried saying that they didn't even operate the flight - even though I have proof, not to mention the many letters they sent regarding the technical problem - starting "our records show that on the flight in question ......"

Just how stupid do they think the courts are?
