I understand that bailiffs powers are relatively limited but that you can apply to have a county court judgement transferred to the High Court - when you can then enlist the services of a HCEO - who don't mess around.
You have my sympathy though Tgon, particularly as you say that the claimant again gas to pay the costs upfront. I agree with your assessment of Monarch Airlines.
Not sure how long bailiffs try before they give up. Is this uplift from CC to HC a CC recommendation or do I instigate it when progress appears to be stalling? The information I find on the next step seems to "sell" HCEO services rather than my direct representation. I'm sure I'm not looking in the right places yet.0 -
tgon - things have possibly moved on since I looked into this but a couple of years ago I was advised to use the Sheriffs Office rather than a County Court bailiff - the reason being the SO are a lot more tenacious and do not give up easily plus they are paid upon results rather than attendance.

MON 8033 Seville to London Heathrow 27 March 2013
Flight delayed at Seville, then diverted to London Gatwick on the descent to London Heathrow
Just to let people know that we have been paid out on this flight delay compensation claim.
We followed the process on this forum, including letters to AESA (Spanish air travel regulator) who confirmed it was NOT an EC.
Monarch would not budge and we did not want the stress of taking it to Court ourselves.
From one of the MSE Flight Delay forums we found mention of Bott & Co. - Solicitors who specialise in Flight Delays.
Bott & Co. were on the verge of starting court action when Monarch finally agreed to pay. Monies were paid to us today.
I don't know how to add this flight information to the list - would one of the Forum Helpers please do that for me.
I wanted others in the MSE community to be aware that Monarch have now paid out on this flight number.0 -

(I don't think this list has been updated for a very long time - it's main use was in the early days to see how Monarch were responding and the proportion of rejections.)
You might post your success though at the Facebook site, MonarchComplaints, who do keep an up to date tally I think.0 -
Glad you got paid out but yet again it shows monarchs claim of processing the flights in order as nonsense as my flight was in 20110

After sending a number of increasingly short-tempered (but still polite-ish) emails and letters to Monarch, including a final Notice Before Action letter to their Chief Executive, Andrew Swaffield, I have now received compensation of €400 (equivalent) each for the badly delayed ZB894 Luton to Tenerife (21st February 2014)
Something was amiss with the port engine - it couldn't be ignited from the cockpit. I don't have any other details.
Of course, this had to wait until after the appeals process was finally ended but I like to think that the "No, I won't wait any longer" tone of my letters helped get this thru' now rather than having to wait as long as Monarch hoped to get away with it.
I really hope Monarch now up their game - I used to like them a lot, I want to like them again (we are taking pretty much the same flight again next month, so it'll be a pretty direct comparison - fingers crossed!)

I think your thoughts are echoed by many a Monarch customer as you seem to have had a positive (albeit with a delay) experience. Unfortunately the vast majority of posters on this thread remain very disillusioned with Monarch - their lack of respect commences when you have the delay, continues when you submit a claim and manifests itself when they make their stupid/incorrect excuses not to pay.
The words apology/sorry just do not appear in the Monarch vocabulary and until such time as they realise that their paying customers are their lifeblood they will continue with their lack of customer respect particularly when things go wrong.
When things go well for Monarch they are good but when they go wrong they are a disaster and they totally fail.0 -
If claimants think Monarch are bad at paying out, spare a thought for the pilots who have been well and truly shafted by the previous owners of Monarch.
