Just submitted my claim to Monarch for a 5 hour 15 min delay on MON1829 Corfu to Manchester 4/6/12. Didn't realise I was entitled to claim until we were handed a sheet of paper when boarding MON1829 Corfu to Manchester on 2/6/14 which was delayed by 4 hours 20 mins (deja vu anyone?). Will also be claiming for the latest delay but if I read the posts on this forum corrrectly some people have already had compensation for the 2012 flight.0

However just because Monarch have paid out doesn't mean they will pay you.0 -
Just heard that the Huzar decision will be given on Wednesday! Not long to wait now! I was just thinking, if the ruling is in favour of Huzar, then Monarch may decide to pay all the claims that are stalled pending this decision. If they pay before the hearing goes to court, will that mean we will lose our entitlement to interest?0

If your court claim included interest, surely you don't have to settle for no interest? I appreciate that interest is at the sole discretion of the judge but I settled before the hearing and received interest.0 -

Just wanted to let you all know that Monarch Airlines have finally (only taken nearly a year) agreed to pay compensation for the delays for me and my fellow passengers.
The only advice I can give it to perservere because Monarch will and have done in my case tried every trick in the book to get out of paying flight compensation.
My advice would be to fill out a Monarch Airlines Claim Form. If you don't get a response within 21 days. Complete a Civil Aviation Authority (CAA) Claim Form and lodge that with them. They usually say they will investigate and you should continue to pursue the airline. Give the CAA 3 months tops to come back to you, if they don't keep pursuing them for updates. If they close your case for whatever reason ask them to re-open it and re-investigate.0 -

Well done! The general recommendation of this forum however is NOT to involve the CAA as if the matter should go to Court their comments may not assist.0 -

Hoorah! I've been fighting this since 2010. I received a final 'sod off' letter in January if this year and I complained to the CAA.
Monarch were claiming an exceptional circumstance due to them bumping the plane at Gatwick. Exceptionally daft perhaps but hardly an act of God.
Anyway, here is my CAA response:
Dear Mr Adamson
Case 1972669
Thank you for your patience with us while we investigated your complaint about the disruption of flight MON2693 on 9 November 2010.
We have reviewed the information available to us in accordance with new guidelines clarifying the “extraordinary circumstances” exception of EC Regulation 261/2004.
It appears from the information provided that the airline cannot rely on the “extraordinary circumstances” exception from the Regulation to refuse to pay compensation. It is our considered view that the airline has not demonstrated that this disruption was beyond their control . As such, in our opinion, the disruption to your flight is of a type which means that the airline should pay compensation.
We have given our view to the airline and have asked them to pay compensation to you as required in EC Regulation 261/2004. Our view on this case is based on the information provided to us, is not legally binding and only relates to the flight concerned. Currently the airline maintains their position that extraordinary circumstances applies and they are refusing to pay compensation. However, we are not an ombudsman scheme and we are unable to impose a solution on an airline.
Whilst you are free to contact the airline again with our findings, if the airline still refuses to compensate you, it is for you to decide whether you wish to take further action on your complaint in court, as there is nothing more we can do on your behalf.
Thumbs up! I have rang Monarch in the first instance and they say that they will correspond to me by the end of today (I hold my breath ... not). If I don't hear from them I shall issue a NBA and get directions to a small claims court.
I do believe that this is the first glimmer of hope for any customers on this flight?

Success!!! Monarch have agreed to pay out for our party (7 people) on our delayed flight (Flight ZB759 Dalaman to Gatwick 22nd October 2010).
Initially I submitted the claim form to Monarch and the claim was rejected. CAA wrote to them and said they should pay up and again they refused.
Used Pickwick Solicitors and they were brilliant and got the result. Used them over Bott & Co as they charge 25% and I believe Bott & Co charge €25 and 27%
On the first page this flight is listed under ‘court success’.0 -
Having written to them on Saturday regarding MON1829 Corfu to Manchester 4/6/12 I received their claim form via email yesterday and have completed/returned them today. Will keep you updated on progress.0
