    No the letter MAY help but it has no legal jurisdiction in a UK court. You have to do a significant more research as you need to know and have to hand far more background/research information than a simple one page letter. Read FAQ's and this thread OR place in hands of no win no fee.

    So as a complete novice re courts and rules and regulations regarding airlines we probably wont get any further. This all seems ridiculous, the airlines can do what they want. we have also contacted these no fees companies who take months and months to get the stage that I have myself. we have followed all advice, writing to them contacting the caa contacting small claims court etc. Is the next stage doing a law degree lol ???

    I have messaged you however I do not have a law degree and I stuffed Monarch however I did wonder at the time if their solicitor and/or barrister had a law degree as they seemed to have some difficulty understanding the relevant law themselves.
  • Hi was looking for some advice, since sending my first letter to Monarch beginning of February and no reply I sent second letter 14 days later and still no reply, I then tried contacting them and waited for ever on phone, and gave up I decided to fill in CAA form back in march, i got a reply from them the other day stating they found the airline at fault and to pay compensation, I then contacted monarch and after another long call I persisted and got through to let them know to send correspondence to my new address, i was then informed I have no claim as need to fill in claims forms for all passengers which to what I was fuming, they emailed them over to me and I filled in and sent back with all other correspondence I have ever sent them including copy of CAA letter, I sent back last Thursday and received email today stating the usual thing extraordinary circumstances due to engine computer fault and they tried to accommodate us on the next available flight within there monarch fleet and we are not entitled to compensation, we were on flight ZB684 03/06/2012 originally due to fly at 10am and flight was changed couple weeks before to 13:55, then arrived at airport and didn't leave until 20:31 there was 4 adults 4 children 2 being infants, was just wondering if someone advise me of next option would it be to rewrite to airline or to go with court action or nwnf company not clued up on all this but don't want to just give up as I presume that's what the airlines expect. thanks any help would be great.

    All the info you need (and there is a lot of it) is in the FAQs on page one. If that is too much or too complex (only you can say) then instruct a NWNF lawyer is my advice.

    You have a valid claim but you need to research in terms of your next (court) move. Either DIY or use NWNF - you have to read up and decide yourself but as you infer - do not give up!

    Hi. I used all the templates and also contacted the CAA in Greece and the UK who both advised I was entitled to compensation. Monarch told me that the CAA aren't a legal enforcing body. I'm now taking them to the small claims court. I have today phoned my local MP. I'm unsure of the procedure re the small claims court. Somebody has mentioned that I need to do extensive research before going to court. This madness needs to stop. If the CAA cannot enforce anything what's the point?

    That is the $64,000 question asked by us all, at one time or another. The answer is there is no point to them for this purpose.

    I'd expect the same useful action as you have had from the CAA. If you want compensation, just read about about taking Monarch to court (all you need to know is in the FAQs) and then do it or speak to a no win no fee firm.

    I'm surprised they both replied. From what I've read, the "regulator" denies responsibility if the flight didn't leave from their jurisdiction.

    With respect Derbyman many of us have been there before. I have sent numerous emails to my MP, MEP (now changed but the new one [July] cannot be any worse than the last one) and the CAA. So far very little back with anything meaningful. A on-line petition received 34 supporters and a complaint to EU achieved 22 'likes'.

    Yes I come into contact with UK CAA through my job, I phoned the UK first to ask for advice, they advised me that they think of airlines like taxi companies "is it extraordinary if your cab suffers from mechanical problems" No. I'm determined to carry on, not just for the compensation but more importantly safety. The more you delve the more shocking it is. The online results were very poor eh. I hope we all get closure and I hope that the way mechanical checks are carried out improves. Airlines seem a law unto themselves.
