    Well I'm not a solicitor but I would say that has basically zero standng in law.

    At the time Monarch crew told passengers that due to the previous week's flight developing mechanical problems and being withdrawn Monarch had made an operational decision not to charter a replacement plane. We had to wait for a greece flight to get to Gatwick then fly out to get us, result a delay of 7hours and 41 minutes.

    Just bear in mind that the 6 year time limit (assuming it's confirmed in the Dawson case) applies to the 6 years from the delayed flight date to the day on which you make a claim to the court, so don't be tempted to get involved in correspondence tennis.

    Yes. Their Lordships ruled that the extraordinary circumstances only apply to those cases where forum posters ask questions that could be answered by just two minutes of reading the Huzar thread, or even just Google newsing it. So it seems you have no claim ... (But you may be entitled to vouchers?)

    Hi all


    Myself and my family got delayed on this flight for 13 hours 40 mins, due to "corroded outboard trailing edge flap lower surface, something that was soo bad it had to be replaced, so not minor corrosion that should have been spotted on earlier flights, I have wrote many times and they have replied with extraordinary circumstances etc., I have contacted caa uk and caa Greece who have told me to take it to court and that they have imposed penalties on them, they still refuse to pay up, . Monarch wrote to me and informed me that the CAA is not a enforcing legal body and that they cannot make Monarch pay anything. What is the point ? and how do they get away with this. ? so now I have contacted the small claims court does anybody have any helpful advice for us. Thanks

    Yes you are on the right track. Take them to court and win your case then enjoy your compensation but do not use your money for another Monarch flight unless you enjoy taking Monarch to the cleaners. Read FAQ's on Page one and read through this entire thread at your leisure as it is probably best to wait for the Huzar appeal hearing before submitting your court claim.


    Oh by the way although Monarch are known to delay most of their flights your premature claim (whilst probably being correct) may be rejected at least until late July!

    Thanks so do you think that with me having a letter from Hellenic caa that states "our authority has imposed penalty to Monarch airlines because in your case the air carrier didn't comply with the provisions of ec 261/2004 from 07/02/14" that will suffice as all I need in court. will we have to actually turn up at court etc. ? sorry for the newbie questions.
