    I feel for you.
    It is nothing short of a disgrace that the small claims system which is supposed to be a fair and simple avenue for the man on the street,is being watered down by some judges who think they ARE the law, rather than just a cog in the wheels of the justice system !!
    Anyway dont despair keep your cool wait the three weeks maybe get a bit of legal advice before you return to court.

    Oh well at least you can keep racking up the interest.
    From what you have said, Monarch clearly aren't interested in this case. Does a judge have the authority to "take on the inadequacies and incompetence" of a third party?
    Bizarre to say the least...:(

  • More importantly, I am struggling to work out exactly where the aircraft (G-MONR) went to between arriving in Manchester from Sharm at 10.35am and its revised boarding time of approx 10pm on 30/09/2012. A Monarch employee let slip that it had flown to the Greek Islands but I can't find any detail.
    Any info would be a big help.

    If it helps, I think G-MONR operated ZB5642 from Manchester to Aktion, Greece on 30th Sept 2012.

    It was supposed to depart at 07:00 but instead departed at about 12:48.

    It then flew back to Manchester and landed at about 20:21.

    Best of luck with the remainder of your claim.

    Adie Cartwright - if it is any consolation Monarch 'mucked' me around and the Judge at my first hearing told them to go away and have a re-think. They had a re-think and still came back - accordingly I sought compensation for two days attendance plus two lots of travel plus two lots of parking costs and the Judge agreed and Monarch had to pay up.

    Any right minded person would only have to browse this thread to see Monarchs attitude to these claims makes no sense on any level. They continue to blow money on cases they have no chance of winning,waste their own and every one elses time, while creating bad feeling and publicity along the way !
    I think what we are witnessing are the death throes of a very poorly run company and after seeing the way they continue to treat people with absolutely no respect i will have no sympathy whatever when they go under !!

    Thanks so much for this vital info CobyBenson. For some reason I just couldn't find the details anywhere (Out of interest, where did you find it?). Hopefully I can now find proof that G-MONR did operate that flight, and that our delay was purely a result of an operational decision that Monarch made, knowing that a delay to our flight was inevitable, and we would be stranded for at the very least four and a half hours.

    Hello,


    After reading on the Martin Lewis site about flight delay compensation, I remembered that we had a flight delay of over eight hours in 2008.


    To cut a long story short, my wife happened to have the invoices, boarding tickets and anything else to do with the flights and accommodation. So out came all the stuff. We had an invoice for the holiday, boarding cards, the letter which Monarch gave us saying there would be a delay.


    So she put a letter together exactly stating at what time all the things that happened on the day. Immediately we were sent claim forms and we filled them in and sent them the same day. A couple of weeks later we got the compensation for the flight plus some more.


    It was a nice Christmas present, but it will probably go on some flights next year. So anyone else that was booked on that flight you can get compensation, so good luck. We received the cheques with no letter of explanation or apology, just go away.


    One question I would like to ask, the people who are having to take it to court etc. and having long delays, do you have all the required documents i.e. boarding cards, invoice, airline letters which they ask for?

    Well done Bob!

    It doesn't matter at all if you have lots of information about a flight or next to nothing. Airlines are not rejecting (99.9% of) claims on the basis that the passenger might not have been on the flight in question and doesn't have specific bits of "evidence". The law does not require that to substantiate a claim. In my case (not Monarch) I have a letter from the airline confirming that I was indeed on the flight. They are, however, continuing to argue that I am not entitled to compensation despite my circumstances falling fully within the eligibillity criteria in law.

    I'm intrigued to know what the circumstances of your delay was. It is strange that a small proportion of claims are paid out without any argument. Why this should be the case I have no idea. If you are going to reject the majority of legitimate claims, why pay any?!

    I didn't have boarding cards but I had copy of booking plus email from Monarch regarding delay - I had requested this as insurance co insisted on seeing. At Court case none of this was mentioned by Judge, Monarch or myself.
    I fail to understand what Monarch are 'playing at' as well. I was awarded my claim in court and Monarch barrister told, in no uncertain terms, he had 'failed' - I have now been contacted by a couple who we spoke to during our 26 hour delay - they have been turned down by Monarch > same flight/same delay and will, it looks like, be the same court - Monarch are 'bonkers'.
