    HI - I think we must have been on the same flight as you.


    Just seen this - wondering if you have had any replies to your post or any success with your claim for compensation against Monarch.


    I have just had a letter back from them ( following my complaint to the CAA in June 2013 - there a bit slow as well) still saying it was due to extraordinary circumstances.


    But we know our original plane was used to go to FARO .

  • Just received compensation for flight MON7014 from London Gatwick to Rhodes Greece on 9th of May 2012.
    I have used a no win no fee solicitor Bott&Co Solicitors.

    Judgement was entered against the airline. The reason why judgment was entered was that the airline failed to file an Acknowledgement of Service at court in time, therefore we wrote to the court requesting them to enter judgement. The court entered judgement and this was then sent to the airline.

    All process took less than a month, I went win a solicitor as I couldn't be bothered due to no time.

    A technical problem with a plane is not extraordinary - it is common ie ordinary and can be likened to a breakdown in your car as proven in many a court case and indeed in Huzar v Jet2.

    To say the CAA are a 'bit slow' is an understatement - not only are they very slow they are very useless when it comes to offering consumer help in respect of flight delay compensation.

  • I have just finished my court statement for my file and have all details included I wish to refer to. I have duly exhibited all other pieces of evidence i wish to rely on.

    A friend of mine has recently had his statement returned from court asking for it to be set out in a particular order, ie. numbered paragraphs, set size of margin, etc.

    My statement has all my details at the top, plus who case is against and the case reference number.

    Just wondering if there is a set format for court statements.

    Sounds like a pedantic Court to me - small claims are there to assist the general public. Common sense to set out logically however set margin size is over the top IMO.

    I'm not sure on the policy of attaching links on here, but if you google "Practise Direction CPR32 - Evidence" you will find the CPR Practise Direction setting out the preferred format.

    Paragraph 17 onward is the pertinent part.

    There were a couple of useful replies straight underneath my post. I would say (in my opinion) that numbered paragraphs are a must - it helps to separate each point you are making in a concise manner.
    The above is just my opinon - which counts for nowt! You must make up your own mind.

    Not that I m aware of, paticularly for LiP. As long as it is clear and easily referenced during hearing. Sounds like to your court/judge is being a bit of an a**e.
    However numbered paragraphs, plenty of space in margin, tabbed/indexed for relevant case law etc are probably requisite, for ease of reference as all partes will be too and fro through paperwork.
