Went to mediation tody, and agreed a figure.

... In some ways it is disappointing, as I really felt that I had a strong case, but in the end, I felt that I just couldn't afford to take the risk. I'd have been really gutted if I'd gone to court and lost.

Yes - bird in the hand and all that.

Monarch wouldn't have offered to pay if they thought they had a decent chance. On top of the Platts factor, I think claimants are in a very strong position now.

But each to their own: and if you're happy with the sum you've got, then well done to you!

Well obviously it is up to you but this is the first case I have heard of where Monarch settled at mediation stage so maybe the latest rulings are starting to get through to them. Was Ms Morgan Ann Mulay on the 'other' 'phone and what is their timescale for payment?

Well, when the mediator rang me, that was the name he said he was expecting to be on the other phone, but it turned out to be somebody else.

The agreement is that they will pay the agreed sum within 21 days

I was offered £500 plus court costs a couple of months ago during mediation with Ms Mullay.
She tried throwing the NEB Guidelines of Apr 13 at me and told her i had a copy in front of me and they are not worth the paper they are printed on. The offer was then withdrawn.
Now still waiting to try and get my case heard locally in the North West, since Monarch asked for it to be heard at Luton and it was transferred to there.

I would be writing a letter of confirmation regarding the mediation amount offer to Ms Mulay saying 'thanks but no thanks' thus confirming to the Court that Monarch admitted (some) liability.

Hmmm. Think that will have been a without prejudice offer Kim.

I agree with that. In my case, the mediator was very clear before we started that anything discussed was confidential, and the court would ignore it if it came to court.

    Hi,
Can someone please advise me on what further action to take.
Below are the details and actions taken so far:

Flight ZB534 (Man - Palma) 27th July delayed almost 10 hours.
    1. 9/8/13 - Used template letter from this site to send compensation claim.
    2. 20/8/13 - Sent standard Monarch claim form.
    3. 18/9/13 - E mailed Monarch asking why they hadn't responded.
    4. 27/9/13 - Received an e mail rejection stating 'Extraordinary Circumstances'. They stated that the plane was taken out of service due to a fuel leak.
    5. 16/10/13 - Following the 'Watchdog Programme' I e mailed Monarch asking them to clarify if they were rejecting my claim.
    6. 30/10/13 - Received another rejection e mail restating ' Extraordinary Circumstances' due to the fuel leak.

Monarch keep stating in their replies that the information is confidential. I smell a rat, they seem to want to cover things up.

I have read in post 4 that a technical fault is not extraordinary circumstances, and also seen several articles backing this up.
(I am not allowed to post the links)

What action should I now take ?

n.b. I also noticed in post 1 that fight ZB534, Manchester - Palma, 03/07/12 (1942) had a successful claim. Would this have been the same plane?

    Any help is much appreciated.
    Thanks
