    I've submitted all the Monarch claim form paperwork and then I've come home from work today to a letter from them they've acknowledged my complaint and sent me all the paperwork to fill in again........got a feeling this is not going to be easy and will be a long job !!!!
  • We had a 9 hour delay ZB682 Manchester to Alicante 15th June 2013
    Sent off compensation claim on our return, waited six weeks received no acknowledgement at all from Monarch, so I decided to email them, next day received an email with the usual ECs.

    Our records show that the aircraft scheduled to operate your flight sustained damage to the rear door of the aircraft by a set of steps.
    Engineers attended the aircraft and began repairing the damage. Due to the length of time taken to repair the fault, the crew operating your flight exceeded their maximum legal operating hours and were therefore required to take a minimum rest period before completing the flight. Usually in circumstances such as these , we would call on our standby crew to continue your flight. However due to industrial action within French Air Traffic Control the previous two days, our standby crew had already been utilised to cope with the unusually high demand for additional flying to ensure the fleet and flying programme were not disrupted. The strike affected all flights operating in and around French airspace, Many areas of French airspace were either closed or heavily restricted due to staff shortages. Routings avoiding French airspace were used but these were heavily regulated due to the huge demand for this airspace. Some flights were rerouted to avoid the French airspace but still had large ATC delays and incurred much higher flying times.

    Despite our best efforts we were unable to transfer your flight to a third party operator and as a result your flight was unavoidably delayed,

    Having considered the factual background of this case, we are satisfied that the disruption was caused by an extraordinary circumstance that could not have been prevented by Monarch Airlines. We are therefore unable to accept your claim for compensation for the reasons given.

  • I would presume that the flight to Alicante is the same plane that returned from Sanford on the 15th of June.
    The plane reigistration was G-SMAN.
    What I'm concerned about my claim is the fact that they use an air strike hundreds of miles away as a valid reason when everyone knows that the ground crew through incompetence caused the delay.
    As air traffic strikes are regarded as extraordinary circumstances I would like to ask what are my chances if I end up in court?

    Flights denied for EC's. Are any of these going to court?
    I'm filling in forms for ZB535 Palma to Manchester 02/05/2011 would like to hear from any other passengers on this flight.

    Number in brackets refers to post number.
    Going/gone to court - mine did - Palma > BHX - plenty on here, Daily Mail, Times, Metro, Birmingham Post etc.
    ZB535 - check yourself to see if listed by anyone else - ie use search facility.

    :rotfl::rotfl: normal delaying tactic.........

    From first contacting them in April 2012 till court date July 2013.....won case , still waiting money!!!!

    so yes it will not be easy but you will get there and if your claim is more than £600 and they fail to pay, you can send the sherrifs in :j

    Star you could be like me unlucky and be the only person on your flight to make a claim, it seems I was the only one on my flight last year yo do so....

    Hope there are others who have , as it will be a help...

    I am off to France tomorrow ( not flying) and will be gone for up to 10 days, I know your mediation and hearing are soon, good luck and will try and access the site from France to keep following:beer::beer:
