My original claim for the delay of flight ZB535 Palma-Manchester on 9/10/13 was rejected by Monarch stating 'extraordinary circumstances' I requested a detailed explanation from them in order to escalate my complaint over a month ago. I have today received an email to advise that my claim has been reviewed by the legal team and that they have agreed to pay out and I will receive a cheque within 21 days. I was expecting a fight but it seems that Monarch have taken on board the new guidelines issued by European regulators in July 2013.

Don't suppose I can use your example in anyway can I ?
Same flight number different year of delay
    (A long shot I know )

Well very unexpectedly I have received an unprompted e mail from Monarch today, thanking us for our claim forms, issuing us with our claim reference numbers and asking us to now give them 28 days to complete their investigation !!!

Wasn't expecting to hear anything at all so I suppose that's a positive !!

to maximise my chances of a payout, can I make a claim from both the airline and the travel insurance at the same time ? if insurance pays up, would they chase the airline themselves or vice versa ?
what if both pay up (highly unlikely I realise) - would I be breaking any laws ?
I know it would be illegal to claim of 2 insurers but this is an airline and an insurer.

    thanks

Totally different things so you can make two claims. Generally insurance pay for delays over 12/24 hours and a set amount of say £30 per 12 hours over a 24 hour delay. You seek compensation for a delay of over 3 hours (subject to certain conditions) from the airline direct and level of compensation depends upon the distance from your destination airport. Not unlikely for both to payout, in fact quite normal if you have a long delay say 24 hours plus.

    Hi Guys

I was wondering if I could get some help. We had ours rejected a few months ago. I have now been reading that since July 2013 new regulations have come in and that you should ask the Airline to reopen the claim. Has anyone done this and if so is there a letter that you used.

    Thank you xx

    There are no new regulations.

If you want to take your claim forward I would suggest going with a no win no fee company to make a claim with, unless you feel you can take it up yourself. Considering you haven't really bothered reading the thread I assume you won't be bothered enough to go through the effort of doing it yourself.

    Aedus..... harsh.... I think!

As a newbie, it's hard to know that all these questions have been asked many times over and I myself probably angered many with asking the obvious, which I see now.

After month's of reading and posting on here I know it get's to the point where you are banging your head..... BUT.... when you join initially, it's hard to know that all these questions have been answered before.

When you hook onto the end of a thread, you don't automatically think of looking to the 1st page for help, or know it's there.

I think it would be a great... & don't know if possible.... but if a quick link could be added to each page as a

LOOK BEFORE YOU POST (A-Z of most things you need) which guided you to the 1st page............

Brilliant information on the 1st page and well done to all who contributed....... :T

    that would help...

Barbara makes a fair point. I recognise I am (occasionally) more intemperate than most in responding to questions that have been asked zillions of times before. But of course to anyone "dropping in" they'll have no sense of just how irritating a question about whether "it says I can claim back to 2005, but ..." or "do I have to accept vouchers" can be, when it has been answered so many times.

My own beef is because I really care about this forum. I am immensely angered by the airlines' cynical and systematic deprivation of their custoners' legal rights. And it offends me that often those least able afford to forgoe these rights are those least equipped to play the stupid games that the airlines put us all through. It is - in every sense - a disgrace.

But we are where we are. So my "vision" for this forum is an easy to navigate library of invaluable info where people can - with a little effort - read up on what they need to know to take the airlines on and get their compensation. But the more people who post unthinkingly about issues that have been answered so many times before, the more difficult the whole thing becomes to use for everyone.

The FAQs really do cover most of the issues, and cannot be difficult to find. Well done to those who pulled it together. But if others, especially newbies, have ideas about how to make this an even better resource, I would welcome the feedback. All of us fighting this good fight want the site to be the best that it can be.

In the meantime, hats off to Centipede, 111KAB and Mark2Spark in particular - and others too - for all their hard work and patience in answering the plethora of questions that come their way.

Despite the best efforts of the airlines and the CAA, the passenger will triumph. The fact that 90% of those here who start legal action get their compensation is a telling statistic. So let's stick together in this common cause, share our best tips and experiences and punish those who would deny us our rights in law.

Let our motto be: "We're comin' to getch ya!"

Vauban is 'spot on' so please, please folks read through the threads before you ask questions. We don't know it all but we will have a damn good job at helping. To me 261/2004 was an unknown regulation until Monarch left me stranded at Palma airport for 26 hours. I researched (mainly through this forum) and went to court, won my case and now two things 1) I can help others and 2) Monarch hate me. So long as you have a delay over 3 hours, it doesn't date back before 25/08/2007 (as of today), you have tenacity and patience help is here. If you just want a good rant at Monarch, lack of food, rubbish hotel, need for boarding cards, etc etc then there is a facebook page .... https://www.facebook.com/MonarchComplaints
Finally when you get your compensation enjoy it but stick around to help others.

To be clear, there are no new regulations. They are the same regulations as conceived in 2004, and the subsequent case law judgements - Wallentin, Sturgeon, and the many others - remain in force.

I dont know what it says on the "home page" but the document recently published on the European Commission website has been extensively discussed. Just search "non binding" - or have a read of recent posts.
