  • Both my outbound and inbound flights were delayed for over 8 hours each way to Corfu in 2010. I have checked that this qualifies me to claim compensation. I gathered together all the evidence via the fantastic links on MSE and sent my letter formed from the template on the site by recorded mail. It was signed for on 9/8/13 (proof from Royal Mail site). It is now more than 14 days since it was signed for and I have received no response or acknowledgement despite the letter threatening legal action after 14 days. What do I do? :mad:

    Suzy, there may be an advantage in starting legal action without any further delay. If you wait a bit longer, Monarch will send you a form to fill in and return, asking for the same information that you have already supplied them in your letter, plus some totally unnecessary information such as photocopies of your passport. Then after a few months delay they typically send a letter claiming extraordinary circumstances. They seem to be hoping to put people off by delaying them and putting obstacles in front of them.

    Since you have already given them 14 days, you've already done the pre-action protocol and you are now all set to start legal action, so if you do it now you will stop Monarch from delaying you. See the FAQs on page 1 of this thread for information on taking legal action. Basically, choose either to do it online, or fill in form N1 and post it. Either way, initiating legal action is actually quite simple. It's only later on that you will need to put together all your information and study the EU Regulation closely.

    Please can you add the following flight to the front page - compensation refused due to EC

    Flight ZB472 B'ham -Sharm 01/11/12

    Flight took off on time but had to land at Cairo to refuel due to 'headwinds'
    Plane then developed a spoiler fault.
    7 hours later (stuck on plane all that time) plane was eventually repaired , and journey continued.

    Now have to decide whether to take this further, my gripe is with the fact that there was not enough fuel to get us to Sharm, and in my eyes that's not down to extraordinary circumstances, just bad planning !!
    If the fault had occurred in Sharm , it could have been fixed quickly by monarch engineers, whereas due to the unscheduled stop in Cairo, they were at an airport where Monarch do not have a presence and it took hours for them to get the necessary permissions to allow Egyptair engineers to resolve the issue !

    Sorry Lisa, I don't see the point in adding any more flight numbers of delayed claims to the OP, the pattern is clear of Monarchs stance.

    Flight MON3788 Manchester to Chania now delayed 7hours due to late arrival of incoming plane. Given £10 refreshment vouchers. Can compensation be given for this delay. Thanks

    Very likely on assumption 'technical delay'. Try and get as much information from handling agents, keep all 'paperwork' including boarding passes and try and swop email addresses with fellow passengers. Keep photographic record of delay board as well.
