    I have sent in my claim forms at the end of December and have not received an acknowledgement. This seems to be the same for most people claiming from Monarch with some still waiting for a response after 3 months. I even tried an email just for confirmation that they have received my claim with no reply.

    I was wondering how long would be a reasonable time to give Monarch to sent the simplest response, 1 month,2 months?

    I would hate to wait over 3 months only for them to claim they could not find my forms.

    phone them and they will be able to confirm receipt

    There is a big difference between 'legal costs' and 'court fees'. The latter are recoverable if you win but the former are not usually recoverable in the small claims court.

    Have a look round MCOL (https://www.moneyclaim.gov.uk/web/mcol/welcome) and the Small Claim Court section 27 under Civil Procedure Rules (http://www.justice.gov.uk/courts/procedure-rules/civil/rules/part27) for more on this.

    Thank youn however the small claims procedure in NI seems to be different from the MCOL

    MCOL is just a gateway to the small claims procedure, computerising the claim and initial defence. Once that's out of the way, claimants are usually allocated to the small claims track at your local county court.

    It's only for England and Wales though as far as I can tell, Not applicable in Scotland or Northern Ireland

    I sent them four emails and two letters with only one email response which was just a general reply .... I decided today to send them an email in Spanish .... hey presto a reply within the hour! Might be worth trying this method (Google translate if you are not fluent) if you are still awaiting a response from Spain.

    Sorry I forgot to say for all those who may be exempt from paying court fees this is the form you need to fill in and send off with your claim.....

    MCOL is ok if you have to pay and it is more convienient, the old fashioned way of paper forms is best for fee exemptions, otherwise if you fill in MCOL you need ot pay and then reclaim it...

    Ok since my refusal I am going down a few routes at the same time,

    The CAA are going to look at my case,

    I have emailed a contact in Monarch that I was dealing with way back at the time of the original delay and she is forwarding my response to the legal team. Basically highlighting the relevant cases that a technical fault isnt EC

    Email sent to the EUclaim team directly

    Letters sent to the legal team to a name and address I was given a few weeks ago

    Giving a wee while for a response and then I think I will be going to flightmole (or euclaim) to take my case to court as I wouldnt be confident doing it myself

    So was I in October as were others, that is as far as Monarch have gotten 14/15 weeks on.
