    Hi again

    I found this item on MSE and it would appear if the flight is delayed by over 5 hours that you can claim ticket refund in addition to compensatiion. Am I reading it right? Does this apply if we still flew?

    "What if my flight was cancelled or delayed by over five hours?
    If a flight is cancelled, or delayed by over five hours, you are entitled to your money back for the!ticket!cost, or re-routing if the flight has been cancelled (re-routing doesn't apply to delays), plus meals and accommodation in some cases.
    You're also entitled to compensation of up to €600, which you can get on top of a refund for the ticket cost."

    You are only allowed to claim 3,4 or 600euro depending on the length of delay and the distance. Over 3 hours delay you can claim for meals etc if you had to pay and were not given a voucher to cover a meal.

    You get a refund, in addition to compensation, only if you do not take the flight.

    Great to hear of some court successes! I still haven't filed my MCOL as I haven't had the funds to do it yet. Now slightly worried after reading the court failure against jet2 as I was delayed due to the knock on effect of a previous flight as well, I'm now reconsidering filing as there is no way I could pay any costs to them.
    Has anyone used a third party company and had no success? I'm wondering if this is a safer route for me just in case the worst happened?

    The Jet2 was an injustice heard by a judge that didn't have a clue about the regulations, I wouldn't let this put you off.

    Monarch appear to be continuing their "Dirty Tricks" campaign in putting obstacles in the way of the majority of claims. They are obviously playing the perecentage game which results in many claimants walking away and not persuing their claims. The real winners here are the Legal Team and Solicitors who are raking the money in because of Monarch stance. They will more than happy to continue in the current vein and will not discourage Monarch by advising them to settle,as this would result in a reducing of their income. I don't know how much it costs Monarch in legal fees every time the Legal team have to respond and the cost of a court case must be very high.We can only hope if enough cases goes against them they will throw in the towel.

    Good morning people new poster here, i have been following this forum and thread with interest for around six weeks. Not wishing to waste peoples time etc i have waited until now to post.
    In July last year my wife and i flew to Paphos with Monarch we were delayed five hrs. The following week our daughters flew out to join us on the same flight exactly, just a week later,they were delayed five hrs.The announcements made to explain these delays were exactly the same, same wording and at the same time intervals,so much so that we were predicting what the next message would be and at what time, taking the pi** would be an understatement. On return i did some research and found that over a 5 week period including the weeks we flew, this flight was delayed four times,with three of the delays being over five hrs. I complained to monarch more or less straight away and was fobbed off with various excuses and apologies and finally they said the E.U. courts were ruling on the laws relating to this in november and monarch would not deal with any claim till after the ruling. After the ruling i contacted them again filled out the claim forms only to be rejected on, Ex circs,unbelievable ! Anyway i have submitted a mcol which they are defending. So i now have a raft of questions which i would greatly appreciate some help with. Suffice to say any experience i gain over this process will be shared as time progresses.

    Bring it on! I would however stress that your questions have probably been answered before with the fundamental aspect (as I proved in Court) being a technical problem does not = an extraordinary circumstance.
