This is just some info for those who are contemplating instructing a claims company. I put this basic query on EUclaim.com's Facebook page just to see what they might come up with. Copied and pasted below
Me to EUclaim.com "5+ hour delay MAN to PMI. Letter handed out with £5 voucher at check-in told of techinical problem. In response to my claim Monarch tell me it was a rudder defect and so no pay out as it was extraordinary circs. I don't think so, what do you think please?"
Response from EUclaim.com "Dear Sue, a technical defect is not an extraordinary circumstance. So we do not agree with the airline. If you want, we can take over the claim for you. You can file the claim with us by filling out your flight details at our website. We will then investigate the situation further. ~Lotte
My response to EUclaims "Thanks Lotte, I do realise that but IMO they'd defend this. I've seen the defence they've recently filed on another very similar claim. What are your fees please and how many successful claims have you had when Monarch allege ex. circs?

I seriously have my doubts they can read Vauban. Firstly they appear not to understand 261/2004 and thereafter they seem to have some difficulty with Friederike Wallentin-Hermann and after their inability to comprehend these jurisdictions they spend THEIR money on cases they have no chance of winning by employing lawyers/barristers to defend a case.
Secondly - Basically they are all working for, or appointed by, an individual (who lives outside of the EU) who I presume hasn't got a clue what his UK Board of Directors are doing other than trying to get back into profit.
They want to sit up and guide a decent Company into profit by using 'proper' means' rather than alienating their customers by rejecting every legitimate claim.

Monarch have just declined my claim with what looks like the standard response I have seen elsewhere on this thread. I plan to reply before moving onto small claims (although will check with my home insurer first to see if covered by my legal protection policy).

Hi I have been writing to Monarch since September 2012 to claim.
My claim like many of this board has been rejected due to "extrodinary Circumstances" (it was a overspeed protection fault on the engine) I contacted the CAA but they replied telling me to write to Cyprus Aviation Authority and basically the letter states they may or not help indivivuals.so In dont hold out much hope there !
I think i will write giving Monarch notice of making a claim through the courts too, Can;t find a template on here though. Let me know how you get on ! anyone else of the Larnaca flight get in touch and I will keep you informed.
Oh forgot to mention was offered vouchers worth £100 per person which we havent used. The Compensation is 400euros each.0 -
Congratulations ! I have been rejected despite filing a claim form for a 27 hour delay due to an engine problem.
I am hoping they will reconsider when i write again threatening court action, best wishes0 -

Just to let you know that I'm another one who will be going down the small claims court (MCOL) due to a flight delay of 30 Hours & 56mins. Yes that is correct - No typo!
Flight number MON302 from Sanford (Florida) to Manchester. Was due to return Friday 17 June 2011 but actually landed in Manchester Sunday evening.
After letters dating back to 2011 yet again your newest response (March 13) was 'EXCEPTIONAL CIRCUMSTANCES'.
Done my homework and there's also loads of help on forums - especially money saving expert (just type in Monarch delays & Compensations. Listed flights denied in O.P.)
sorry but 'exceptional circumstances' does not cover technical faults. This has been proven in court law (check out the The Wallentin judgement).
Please don't say ring the claims dept, as I did today and was told to just write in!
I explained that I would be issuing court proceedings .... face bothered!

Filed a claim online 15th April, and received an admission from Monarch 13th May (I have been away on holiday so this was a nice suprise when i arrived back yesteday).
Followed the advice on the letter and requested for judgement to be passed yesterday and for the payment of £740 to be made immediately so fingers crossed cheque will be in the post soon!
