  • We were delayed over 20 Hours on our flight to Florida in 2008 due to a technical issue.
    Our kids were devastated as they handled it terribly (We had boarded the aircraft got comfy and before they discovered the fault). All the kids were crying when they asked us to leave the aircraft.
    The airline (Monarch) handled the whole thing terribly by taking us off the aircraft and continually telling us they were just waiting on the new part being flown in from wherever, until finally sending us to a crappy hotel overnight where they didn't even have a room big enough for my husband and I and out two small kids so we had to sleep in two rooms.

    We lost a whole day of our holiday never mind the stress of the knock on effect of letting the car rental company and accommodation in Orlando know that we were delayed.

    We were not compensated in any way shape or form apart from a few vouchers for food while we were at Manchester airport.
    I have the flight stat report that confirms the delay but I cant find the booking reference now and the travel agency we bought the flight through is now no longer trading.

    My question is - can we claim without having the booking reference? I really hope so as it really would be Devine retribution for the terrible service and stress we received and would go towards our next holiday.

    There is nothing to stop you claiming, but Monarch will not play fair and wil probably ask for evidence that you were on the flight. You could ask them for the information from their own records, but i suspect they wont be helpful. Is there nothing you have anymore - from old emails, etc - to show you were on the flight?

    Ive gone through every email in my system and the worst part is that my son always keeps our boarding passes when we travel and we moved house last month and I think I threw them out - Arghh! Cant believe it.
    I booked the flights over the phone and they sent me old fashioned flight tickets rather than an email. Its so frustrating as its the first (and last) time i booked seats this way.
    We even paid more than normal for the seats as I booked the gold service instead of the normal economy as a treat so they flights were expensive.

    I know they will probably try every trick in the book to get out of it.
    Im still angry about it now even after all these years as it was so badly dealt with. We go to Florida nearly every year and Ive never flown charter again since this occasion due to their lack of customer service.

    We flew last year with BA and they cancelled the flight out to Orlando the night before but they dealt with it as it should have been and upgraded on our seats the following day for us along with extending our trip by a day to compensate arriving a day late so in their case I wouldnt claim as we felt they dealt with it fairly but Monarch were shocking.

    The only other thing I can think of is to ask Monarch formally for confirmation you were on the flight. This is sometimes called a Subject Access Request, I think: search on this forum for others who've done this (including "SAR"). I think the thread entitled "gutted" has got someone who's doing this. Some of the airlines charge a tenner for it, I think.

  • Does anyone have any information of Flight Mon 5764 Gatwick to Sharm el Sheikh 09/07/2009 it was delayed for around 5 hours if I recall. I looked for it on Flightstats but it doesn't recognize the flight number stating that no Monarch flights landed that day!! I only have my booking confirmation from Cosmos no boarding passes!

    Hi all,

    Hoping for some advice....

    We need to complete the Allocation Questionnaire as part of the MCOL process and hoped for help on a few bits...

    1. I’m assuming it’s not worth using the small claims mediation service (phone call)?

    2. Location of hearing- we would like this to be heard in our own city. For what reason could we ask for this; work / family?

    3. “Do you want permission to use an experts report at the hearing?” Would the Wallenntin-Hermann and Sturgeon Judgements count as this or not?

    4. Within the "Other Information" section I am unsure what to put in here. There is a lot of evidence I feel Monarch have tripped themselves up on, but reading much earlier in these posts, Centipede and Vauban mentioned keeping it close to your chest and saving for the day, is this still recommended?

    In terms of questions for the other party, my main question for Monarch would be around their below response which to me makes no sense and I would like further information on this- do you think now is the time?

    “The Defendant submits that the aircraft scheduled to operate the Claimants flight suffered a delay as a reaction to an aircraft within the fleet suffering a cracked windscreen”

    Thanks all in advance for your advice and ongoing support, I would not have managed this alone!

    There are guidance notes with it with some odd comments such as "for legal reasons" they are only accepting claims up to 2 years from date of arrival of the delayed flight. I've just queried this on the Monarch Facebook page and they say they'll get back to me as the claims team has gone home. The notes also give the CAA guidance about extraordinary circs which must be taken with pinch of salt.

    I'm having difficulty formatting and entering information on this form. Have others filled it by hand?

    Hey Monty - I submitted my allocation questionnaire last week.

    To answer your points in turn:

    1) I ticked yes to mediation: it's not really appropriate for this case, but I thought I'd show myself willing to settle out of court (albeit on the terms due to my in law). Some people have observed that to tick "no" may come across as unreasonable.

    2) I chose my home town court, and said this was most convenient. I believe the convention is that, when an individual takes a corporation to court, the individual can choose the court location.

    3) Experts reports are not ECJ judgements, but documents prepared specifically for your case by experts you have commissioned. I don't plan to call any experts.

    4) I was conflicted about whether to ask Monarch difficult questions now, or save them for the court. In the end I went for transparency: not least to signal to Monarch that I know they cannot answer my questions credibly, and therefore that my case is solid. Some cases don't even proceed to a formal hearing, apparently, so I wanted the difficult points out there.
