    Some cases can be decided on the available evidence held about them but they are the exception.

    I presume these are people who have undergone multiple PCAs over the years that they've been on IB so there will be plenty of previous evidence for Atos to [STRIKE]ignore[/STRIKE] take into account?

    Possibly but no-one can be turned down without a 'medical'.

    Other than previous evidence held on file what reasons could there be for a non-isssung of an ESA50 and gain entry into either the WRAG or SG?

    If DWP send a referral to Atos Healthcare for someone on IB to be assessed for ESA there will be a questionnaire issued. You would need to ask the DWP if there any circumstances where they would not send a referral to us.

    Unfortunately the last DWP official I spoke to didn't even know that you could ask for your WCA to be recorded!!! Worrying eh!! But perhaps not for Atos!

    So I very much doubt they'd even know of this situation even though it is covered quite extensively in the Atos Medical Services Handbook!!!

    I am not answering your exact question here as you asked to 'gain entry' and also 'non-issuing'...

    However I received a call today from someone in the DWP today with a bit of sense (I should imagine that they will have him stuffed as a result - either that or take disciplinary action against him) and he said that I could ignore the ESA50 that ATOS sent last week and that they would "spare (my partner) the ordeal of ATOS for a year". I didn't want to go into the reasons too much in case he changed his mind but imagine that this was either due to a recent DLA decision or that ICE are investigating the DWP & ATOS at present for the previous claim... so there can be other reasons I guess as opposed to an automatic ATOS assessment.

    Well done. It is odd though that according to the Atos Rep it's the DWP that tells Atos to send an ESA50 out!!
