    Advice on what though - it's all so vague - someone at the job centre "said", "got in touch with decision maker" - you need to sort out your paperwork, forms and written replies and question the details and text and ask for advice on that!
    We've given you links on local advice centers, employment opportunities, community groups and short term measures e.g. the local foodbank but without any details or a decision to question people are very limited in advice and by offering emotion and opinion that it is wrong you are just soliciting the opposing opinion. Debating the *written* response failing the HRT would be more constructive.

    yes she is supposed to start next week we dont know if its funded not sure how to find out. If it isnt funded she wont be going as we cant afford it.

    No, I just got back in from work, yes, work, what some of us do.

    Not only have I got a regular job but I also have a taxi licence and often work nights, especially weekends.

    This is because if I want something and can't afford it with my regular wage, I do extra taxiing work in order to afford it.

    That's how we had a week away last summer.

    I planned for my daughter by first getting a job, then a home, then a taxi licence as I will always, touch wood, be in a position to earn some sort of money to provide for my family.

    I don't, and never have, sponged off the state, I've always worked.

    Your daughter has not one, but two children, she planned a family and there is no reason whatsoever why she never put in place plans to provide for her family too.

    If I can do then so can she, and countless others like her.

    If it wasn't a Spanish problem then there would be no problems getting help here, would there?

    But no, you and your like just want everything on a plate whilst mugs like me work extra as we have dignity.

    Again, get back to Spain and do your sponging there!

    If you think someone can just walk into any temp job in this country just like that in the economic climate as it is,you are truly deluded.

    Excuse me???? Who the hell are you to call me deluded for giving someone advice? There are jobs about, but unlike a lot of people seem to think you actually have to get off your butt and look for them. When I was unemployed I printed off 50+ cv's and went into the town centre and handed one to every shop. I applied to everywhere, kitchens, bars, cleaners, shoe shops, McDonald's etc. I got 24 interviews and was offered 4 positions in 4 different places. I didn't have the opportunity to be picky. I hated that job but at least I could put food on the table.

    Next time think about what you post. Deluded?? Get a grip

    OP some posts back I gave you information on how to apply for Habitual Residence and a link to the forms they would need to fill in and the documents that they need to produce to support an Habitual Residence claim.

    I asked you for information so that we could try and help you with this specific issue (since that is the title of your thread) but I cannot find any response from you on this thread.

    Your daughter and her husband have two choices - they either comply with the requirements and procedures necessary to prove habitual residence, or they don't. It is no good expecting the benefits agency to sort this out as it it is not their priority. But it should be her priority.

    Hi. My daughter was not asked for proof of closure in Spain which she has.
    She is registered at docs has bank account, daughter registered at nursery etc. But she doesnt recall any questions regarding this.
    She now has an appeal form which we will take in tomorrow. And demand that she retakes the test. A benefit decision maker phoned her on Friday to tell her she had failed. But nothing in writing. Before christmas she was told she was getting her jsa on the 21st but she got nothing. She has signed on 3 times her claim is still live on the system but she isnt receiving any money.

    If I am honest, people like the OP have no clue how hard we are working so they can enjoy their lives.

    An example: I did a project for a client few months ago, it lasted a month and to do that project in a month I had to drive 100 miles a day , go away at 5 am and be back at 10 pm, massive pressure to finish work, got stuck in traffic jams, weekends spent fixing problems etc etc. Client paid my company 3K for this work. In the end I had to give away about £ 400 as tax from the profit of that sale.

    People like OP spent that money in a week to live in a massive house. And all because I sacrificed and slaved away to generate that cash. They really are detached from the reality.

    OP, the habitual residence test is a complex area, and she needs specialist advice.

    Has she been to see the citizen's advice centre or a law centre for help with this? Some areas also have specialist immigration lawyers who give free advice through the CAB.

    There is a form on this site to help her find a specialist adviser in your area.

    I cannot stress enough that she needs to get assistance from a professional adviser who can help her with the documentation etc, otherwise she will be passed from pillar to post.

    In the meantime, she should do eveything she can to show that she intends to settle and remain in UK. Such as enrolling the eldest child in school (I presume she has already done this), enrolling the family at local doctor, dentist, being on the electoral roll, changing her driving licence, bank statements, and any other official documents to your address. Possibly most important is finding a job - if she can find 24 hours a week (bar work? Waiting on tables? cleaning?) she would be much more likely to pass the habitual residence test and would be able to claim CB, CTC etc.

    But whatever she does, she really needs to seek specialist advice and assistance from one of the advice agencies.

    Absolutely agree.

    Despite having two jobs I can still struggle financially and I recently missed a month's Council Tax.

    Bang! Within a few days of that month ending I had a threatening letter off my council to bring my account up to date or face court action!

    Spongers don't understand this, they just take, take, take!

    And now they're coming from Spain to bleed us dry!
