My daughter returned from spain with her partner and 2 children 2 months ago. After he lost his job and they became homeless. They are camping out in my living room. I have helped out as much as i can but now my money has ran out and cant help any more as i have 3 other children. She has been refused all benefits as she has failed the habitual residency test. She isnt even getting child benefit. We are all suffering the children are poorly all the time from lack of the right food and not sleeping properly. We just dont know where to turn. She applied for a crisis loan this morning and has been refused that as well as she failed the test. She is british and has cut all ties with spain and has proof. But wasnt asked for any of this at the job centre.
Any advice will be appreciated she is only 20

I take it she came to the uk to get benefits as Spain don't pay benefits like we do and they have no cont based rights?0

Good spot, OP what happened since the 8th of December as on the second thread it appears it was all sorted then?
Unless you have another daughter aged 20 with 2 kids living at home with you.Thinking critically since 1996....0 -
I dont understand why there is no talk about find a job in a pub/bar whatever. Only talk about benefits and how they are not getting any.0

Why are both of them out of work? 2 months ago there were many temp jobs over the festive period. She will have a national insurance number as she is UK national and her partner can apply for one if he finds work. Are they doing everything they can to find work? What happened to the HB mentioned in your previous CAB posts?Saving money like a trouper...0

Apparently the Spanish partner worked cash in hand (the OP thinks this is normal in Spain!) so is ineligible for benefits there.0 -
Well thanks alot i thought this forum was about getting advice not critisism i will go elsewhere for advice in future. Are you all in work today or are you sat at home trying to wind people up on forums??? If you are at work i suggest you get on with it before you are in the same boat as she is!0

I think people are being helpful. Its very important that your daughter and hubby do not get sucked into a life of benefits but instead learn hard graft. You seem to think they are "entitled" to be looked after by the state.0
