Mother died with debt and no estate. Help needed

    Again, it's up to you. If they phone you and you have copies, you can send them - I'd add a letter stating that you are not dealing with the estate and not to contact you again.

    I don't think I would bother sending anything.

    If you sent certified copies it will cost you money to get them and the postage.

    Re read many times. Some say send off death certificates, others say don't. As I said when I made the thread though I already called and told people and they wanted certificates

    Most if not all that say "do stuff" have not taken into account the estate is insolvent.

    They can "want" certificates but it is not upto you to send them unless you want to.


    They can always get them themselves from the registrar and save you the expense.

    After saying they would write a cheque to "the late", phoenix are now saying they won't

    So ill get them to pay the funeral director, but there will be money left over which apparently I will have to claim. Shall I just not claim the rest after the funeral bill has been paid?

    Get them to pay the funeral director and then take a step back.

    The money that's still owing to your mother's estate is then Phoenix's problem. If they send it to you, send the cheque back, saying that you are not dealing with the estate. I expect they'll suddenly find they can write a cheque to "the late" and have it paid into the account.

    I am filling the in claim form.
    Filled in the Funeral directors details, but then you have to complete the section for where to send the rest of the money according to the lady on the phone. Apparently all the money has to be claimed at the same time

    So £xx to the funeral director and the remaining £xx to a bank or cheque (but not my mums bank or a cheque saying "the late")
