Mother died with debt and no estate. Help needed

    When I have sorted out the funeral, should I still send off copies of the death certificate to each company and just give her address?

    Just concentrate on the funeral for now. Make it the best you can and ensure all are welcome to attend - (barring networkers). give your Mum a good send off and worry about the admin later.

    If you have not got the support from your family, there are pleanty of advocates in your community to help you through finalising everthing. In fact, it's often better to seek help from outside your circle of family and friends at a time like this as those you think closest to you, won't often hang around.

    This is more likely to be because they don't know how to approach you, as well as carrying on with their own lives, so don't take things personally - it's just the way it is.

    I know this won't help you at the moment, things are probably still too recent and too raw, but when my sister died and one of her creditors kept contacting me, I eventually told them to send the court proceedings to my sister at her current address. I enclosed a photo of the grave, with the name and address of the cemetery.

    I never heard from them again....
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

    I ended up telling one of my late husband's creditors that as they were so intent on contacting him they need to ask the crematorium to show them where his ashes were scattered, that got rid of them.

    Heather, please stop worrying yourself over the debts, just deal with the funeral and do as others have said - walk away from it. I had no choice when my husband died as I was his executor and sole beneficiary, but believe me if he had known, or I had realised, just how nasty SOME creditors can be, it would have all been left in the hands of solicitors. If you try to deal with any of the debts you won't get any peace from the creditors, they don't make allowances for the fact that you are grieving, all they care about is getting what they think they are owed. Please don't put yourself through it, you mum certainly wouldn't want you be caused any more grief, she would want you to look after yourself and to hell with the creditors!

    OP, since you mentioned the bank is RBS, can I ask; was your mum domiciled (resident in) Scotland?

    Re read many times. Some say send off death certificates, others say don't. As I said when I made the thread though I already called and told people and they wanted certificates

    Nope, in england

    You can send off certificates if you want to but you don't have to.

    Btw I am sorting the funeral first. Already arranged it. Waiting for the date

    I am not worrying about the debts before the funeral, just getting things right in my head so I know what I'm doing. It's who I am and how I do things
