sitting in the works car park to listen to you "answer phone message" would have been better, justice served drivers know the law around mobiles, if in hand a FPN in the other if caught.
have you told your insurers of you pending point and possible ban?
have you told work if its you job to drive around for them?
when you banned youll declair for 5 years after end of ban to you insurers great stuff!0 -
When you can buy a bluetooth handsfree kit that sits on your dash for under £20,why does anybody need to use their mobile phone when driving.The sooner they bring in a 28 day ban for those caught using a mobile phone when driving the better.0

Sounds like you need a wakeup call. If I had 9 points I'd be driving like an old lady, and certainly not on my phone.
I can often spot people who are on their phones from quite some distance back. They think they are in control, but they are not - I see them slow away from junctions, slow to see things ahead on the road, poor road positioning.

When I was young and idiotic, I had a spate of collecting points like they were fashionable, like you had six and possibly six to add, however I went to court and they applied some leniency , in that I got 5 points, I tell you though after that I certainley learnt my lesson, no more convictions in over 20 years.
As for the mobile phone thing, no need to get caught, £45 (can get other ones cheaper) for a parrot car kit, cheaper than a fine and points, and so much cooler than driving with a phone in your hand.0 -

Back to the original question ... OP, delaying your court hearing won't make any difference. The 3 year period applies from conviction to offence. Therefore you count back 3 years from the date of the most recent offence and include all points imposed in that period.0

Take driving more seriously. The offence isn't 'talking on the phone' it's 'using a phone' or being distracted when driving. Listening to an answering machine message is just as bad, and there's really no need to be doing so without parking up somewhere.
If you're already on the brink of being banned, then you really need to try driving like a saint. The point totting isn't to make you wait before breaking the law, it's to get persistently dangerous drivers off the road.
As for stalling until one set of points comes off your license, I wouldn't rely on that working either as they won't be happy if they catch you at it.0 -
I have last week been to court regarding this, totally blagged it, pleaded not guilty, told the court i was placing the phone on my dash board,
Luckally the police didnt submitt any evidence so my not guilty claim was un challenged
Result - No points - no fine ......... phew0
