    With 6 points already and 3 points knowingly about to be added..... why are you not being super careful? But instead choosing to use your mobile phone whilst driving when you could have checked it just 2 minutes before...
  • Section 164.8 of the RTA 1988.



    If you don't have physical possession of your licence because it is with the court it isn't reasonably practicable to produce it with the 7 day allowable period so provided that you do so when you receive it back, you are acting within the law.


    That's for production.

    To comply with a FPN the licence must be produced and surrendered within 7 days and the fine paid within 28 days. I don't see that section of the act making provisions to extent a FPN.

    I was stopped today and issued with a ticket. The police asked if I had my licence which I didn't, he responded that that wasn't a problem as they would just check it with the station. The station called back with all my details and that was fine.

    If you want to accept an endorseable FPN you have to hand over your licence at some point - the points have to be added to it after all. If the ticket is for a non-endorseable offence then it's not so crucial.

    However if the OP ends up on 9 points on Tuesday he won't be able to accept a fixed penalty in any event, so in that respect at least whether he can surrender his licence in time is academic.

    Can you tell us what act and section covers extended production time?

    You are the kind of driver that the toting up system is meant for. I question whether you should be on the road at all. .

    Once their insurance company finds out about all of their offences and increases their insurance premium accordingly, they may not be on the road much longer.
    (well, thay may not be on the road with valid insurance cover in place).

    I was leaving work tonight and within 2 minutes i had been pulled over for speaking on the phone. sods law i was only listening to an answer phone message.
    But lucky for the queue at the nearby bus stop that you didn't smash in to them while you heard the message from your wife to pick up that all important takeaway.

    Seriously, you're on 9 points. I'm stating the obvious but what the hell was so important that you had to hear it, but so unimportant that it wasn't worth pulling over to deal with?

    You should be banned. You'll need an expensive lawyer not to be.

    Other road users need protecting from you.

    Yes that is a fair point but still probably not necessary at the roadside nor later on 7 day notice.

    What kind of ticket were you issued with?
    Make everything as simple as possible, but not simpler.
