  • Hi Tracey, there are quite a few cases both on this forum, and others that show that people have had success by taking their case to the Financial Ombudsman. (Do a search for Financial Ombudsman, or Ombudsman of the forum and you should find them)

    I'm currently going down that route, it seems the most appropriate to me as I wish to raise other matters in relation to allowing me to withdraw money from my account when I didn't have that money, returning direct debits unpaid when the necessary funds where in my account, then being charged for those returned direct debits later.

    As well as a possible breach of the Consumer Credit Act 2006, because I don't feel they've acted fairly, and responsibly in their lending decisions, and their hidden unauthorised overdraft limits need to also be questioned in relation to their Consumer Credit licence. Plus it appears there was also a breach of the data protection act, as they didn't securely handle my personal data, and sent my last statement to my previous address despite me following all necessary procedures to change my address.

    Of course, not everyone will have additional matters to raise like this which the Ombudsman can address, and the best route available to them may well be the court.

    At the end of the day the choice is yours, whatever you decide, good luck to you.

    I went through the Ombusdman after I couldn't resolve a dispute with Northern Rock. This was for mortgage fees, not bank charges but the initial process is the same. You can download a form from their website:

    Once they receive your complaint they will write to you to confirm receipt. Then you just have to be patient and let them contact the company you're complaining about.

    I was successful in my complaint after involving the Ombudsman and think it's well worth a shot.

    I am currently filling out the form now online for FOS but I am stuck, they ask for Nationwides Annual Turnover and they need to see proof of it. I don't know it have looked on this site and internet would anyone know how I would find it out?

  • The question relates to your turnover if you are a business, not the Nationwide, just ignore it as its not relevant

    Amount Abbey have offered to settle=£3050

    Hello to everyone hows it going, well i would like to tell every new claimant to go straight to the financial ombudsman not send letters and letters because 4 weeks ago i done my claim through the FO and friday 24 june i had a letter saying that abbey will settle my claim for £3050. I am in 2 minds wether to accept it as my full claim is £4460, as i have an interview next week for a job i will probably accept the settlement offer if i get the job if not i will turn down this offer of £3050 and push for a little more.

    I think £3800 should do it..:D lol but seriously all new claimants thinking i wont get anything and when it comes to money it doesnt happen for me kind of attitude..GO FOR IT YOU WILL SUCCEED the money is yours just tell yourself my bank owes me big time. I would like to thank martin and this website for letting me know about unlawfull bank good luck to everyone although you dont need it!.:T

    Out of curiosity, has anyone got any success stories to tell after using the Financial Ombudsman? There doesn't appear to be many unless Ive missed other threads. I have decided to put my complaint against Abbey with the FOS as I have been playing the Abbey mind games since Feb for 2300, any comments would be appreciated!!!!!!!!!!!!!!

    GAt Last another FOS soulmate ! I have used them in my fight agains Lloyds and praised them on the Lloyds reclaim site..They were great.I was not gonna waste time with court worries, I filled out two forms and they did all the rest. And it's FREE ! ! They were great and I cannot understand why there are no posts of praise here..Madness !Good Luck and enjoy your reclaimed money. Mine paid for a family holiday to Egypt !S x

    this is my first post too
    i am also claiming against abbey for just over 2000 quid
    i was a little worried about lack fos threads but sent my complaint to them today anyway.
    just as O'Neill this claim has been going on since feb, abbey seem to be draging it out as much as poss
    lets see how we get on
