    Hi jane25,
    I am going via the ombudsman and I have a personal and business account. They advised me that they would both go together, however these are both with the same bank. Hope this helps,

    i got a letter from them saying

    i refer to your letter dated 14th may 2007 which has been passed for my attention. I have noted your comments, however, i feel we have acted fairly in offering to refund the difference between our previous charges, and the OFTs recommended threshold for such charges. the OFT did not find these charges to be unlawful, and as previously stated it is questionable as to whether they apply to mail order.

    Also in view of the recent case of Berwick-v lloyds tsb, in whivh the court dismissed the claiments claim we are not prepared to issue a refund.

    The FO are likely to agree with the OFT ruling so if you want to proceed for the remainder you will need to threaten court.

    Which ever way you decide you go you do need to have been pursuing this for 6/8 weeks or have a definate "no" letter from the bank before the FO will take your case on.
  • Just received my statements from Yorkshire Bank, just wondering if anyone has had any success with them using the Finacial Ombudsman.
    The plan is to try them first and use the court process as a last resort to give me two attempts at getting my money.
    The problem is that using both could take a very long time, so has anyone any recomendations

    Hi all,
    Brief History:
    1st letter sent 7th Feb, including 10.00 fee
    statements recieved Saturday 2nd June
    2nd letter sent requesting charges refund 5th June.

    I have had to contact the Financial Ombudsman as Abbey have made numerours errors and have used lots of delay tatics in the last 4 months. Anyway, the FO have agreed to take my case on and have already started communicating with Abbeys legal team, Abbey however have refused to talk to me regarding my account as their is now a third party involved.

    Has anyone else used the Financial Ombudsman? If so what happened? My claim is for 2305.00, I'm not sure what to do now apart from wait!!

    Hi o'neill , I wrote to abbey with regards to my bank charges , they offered me £50 goodwill gesture and no responsability on a bill of £139.
    I contacted the financisl ombudsman and they took my case on after I filled in some forms and sent a copy of the offer letter.
    It took about 6 weeks and the F.O sent a letter saying abbey agreed to pay £139 with no responsability.
    So hold tight they are doing there job and will be in touch , just give them some time , if in doubt give the F.O a call

    Also the abbey kept sending letters to me saying they needed another 4 weeks and they were 'investigating' my claim
    The FO are the right way to go

    Hi All,

    I am currently in the process of reclaiming bank charges from 3 different bank accounts:
    LLOYDS TSB - £1,718 (incl int) 2nd letter requesting repayment

    ABBEY (sole acc) - £1,353 (incl int) 1st letter requesting repayment
    ABBEY (joint acc) - £1,378 (incl int.)
    STAGE:
    R'vd letter from them informing me full investigation has now been carried out. Charges were correct, but will refund me with £60 as a gesture of goodwill! I have RESPECTFULLY declined this offer and once again requested that they return my charges. However, I have accepted the sum offered ONLY as part settlement and on the clear understanding that I will pursue recovery of the remainder with the financial ombudsman!

    I am definitely not one for conflict and I'm so scared and don't know where to go from here. :eek:

    Court or Ombudsman??? And how do i go about it? I read on a thread earlier, that someone lost a case last year because they were not prepared enough!!! How prepared do you have to be???

    Please help!
