    Yorkshire Bank do have an unenviable reputation for playing dirty - They routinely tell claimants that the courts will treat them unsympathetically because of their misuse of their accounts.

    I think I'm going to have to contact the Financial Ombudsman too - I have 2 accounts with Capital One that I'm trying to sort out and just can't afford the bank charges at the moment. Thanks for posting the info and links here.

    i have just recieved my get stuffed letter from Shabbey which came 4 days after 8wk deadline I had already lodgged a complaint on the 8 week mark wtih the FOS.
    Have been through all stages except going to Court.
    should i wait to see what the FOS has to say or should i just go in for the jugular.

    Hmmm, not too sure about the font. For a moment, I thought someone had nicked my Dell and replaced it with an IBM XT running MS-DOS!

    As you've already passed it to the FO, I'd let them see what they can do. Whilst they cannot make the bank pay up or set the level of the settlement like a court, a formal FO investigation costs the bank £300 or £400 and threatens to open more skeleton-filled cupboards than any firm would want.

    If the Financial Ombudsman is unsuccessful, you can still take the bank to court.

    I've received a Notice of Issue from the court and Abbey have until 18 June to respond, in the mean time Abbey have made a goodwill gesture of £600 but my claim in for £1,711.00 . I've wrote back saying I'll accept as part payment and will continue with the claim through the court.

    Is it worth me contacting FO at this stage to push abbey to make me a better offer or shall I just wait for the 18th June. How long does the FO take on average to sort out the complaint?

    having a complete nightmare with lloyds at the mo in general, not very helpful, have already got a claim going through MCOl, but would like to make a general complaint to the financial ombudsman anyone have the address or phone number??:confused:

    Have a read of the Ombudsman's website - http://www.fos.org.uk/contact/index.html

    But as a word of warning, they can't take a complaint until it's been through the bank's full complaint process and you have what's called a Final Response from the bank (ie a deadlock letter).

    The banks hold you off for as long as posible in the hope that you accept a lower offer, drop the claim altogether, or get rejected at court.

    Bankers don’t live in the real world, I know this for a fact as I have worked for a few in the past, and they haven’t quite realised that this is an expensive game that they are loosing! Quite frankly the more I have dealings with my bank on the issue of reclaiming charges, the more I dislike their attitude and service, but its better the devil you know I guess as they are all the same.

    So far in all my dealings over charges I’ve found HSBC to be the Best for Service, unfortunatly I don’t (yet) bank with them and only got the credit card because I walked in to PC World! But I’m seriously considering moving to them when all my claims are finished! :)

    I have just recieved a letter from TSB offering to settle my claim for £750. However, my claim was for £4500 so i plan on taking them to the Ombudsman. What i would like to know is - if i accepted the £750 as 'part payment without prejudice' would it affect my case with the Ombudsman?
