I no that I'm not stupid! My point is I think this was done just to get there hire car back from me, so yes it makes a difference because if they use printed cheque then I no it's true... The cheque I have was never going to clear it was probably canceled before it was even issued0

I feel sorry for some of the staff, and some of the customers. But having deal with this company for 4 years I am so glad they have now got what they deserve.
The consumer won't often know - but Drive Assit were subscribers to the ABI GTA, which set out guidelines for how Credit Hire claims should be operated. Drive Assist were one of many Credit Hire companies that would deliberately delay claims as long as possible by not obiding by the guidelines in order to elongate hire claims as much as possible.
One example was delibrately witholding Engineers Reports from third party insurers, and sending them to the First Party insurers - guarenteeing an extra week or two of hire. Directly against the ABI GTA.
Perhaps now people will start to liaise with insurance companies - rather than jump straight to the company that offers them a fancy car at no cost, and we can see the back of the other scum bags in the industry - AI Claims Solutions, Helphire, Kindertons etc.
If you need Credit Hire go to Enterprise - they operate within the framework and with morals and principles - unlike the likes of Drive Assist.0 -

This seems a cynical post to plug another credit hire company!
There are plenty of posts on MSE asking how to avoid buying insurance which uses DA to deal with claims from clients who are blameless!
It is the insurers who have been happy to force us to use DA - wonder why???0 -
The insurance industry for years have been at war with the credit hire companies, because they don't like the rates the credit hire companies charge.
The ABI GTA exists which stipulates a (non binding) set of rules a claim should operate by. This also includes the agreed rates for the classes of vehicle. Yet despite this, the insurers still argue time after time about rates and start asking the innocent motorist for bank statements to see if impecuniosity can be proven or not.
The insurers are the hypocrites in the game though as it is largely the insurance industry that feeds the referrals into the credit hire companies. So they feed claims to the credit hire companies, but squeel like pigs when they are on the receiving end of a claim.0 -

The cheque wouldnt have cleared no matter in what form . Depending on when the cheque hit their bank it may not have bounced through lack of funds , when administrators get called in bank accounts are frozen.
You need to contact the administrators , be warned it can be a very drawn out proceedure

I would guess that the reason Focus05 received a handwritten cheque from DA would be because they probably received a cheque from the third party insurer for more than just the write off value. There could have been an engineer's fee or the payment of some hire charges as well as the customer's total loss money.
So they probably banked the cheque, took off what was owed to the customer and sent him a cheque for that.
I don't see what the relevance of a printed cheque or handwritten cheque would be.
In this situation, because Drive Assist have sent the total loss cheque (having banked the original cheque from the insurer) this will cause a problem with the third party insurer, who will not want to pay the write off value of your car again.
At the same time, they don't want you riding around in the DA hire car still.
The problem here is that the administration of DA is an intervening act and not a direct consequence of the actions of the party at fault for the accident, so the third party insurers probably will refuse to make another payment (unless they have some form of guarantee from the administrators of DA that any money paid to DA for write off settlements is "ring fenced" so the insurer would get am refund from the administrators if they write you out a new cheque.
I would recommend you contact the administrators on the details posted earlier on in this thread and explain your situation.
If they can't help, then call the third party insurers and explain what is going on.0 -
I was thinking for a while then why DA went under but then realised so many insurers challenged your payment packs it's no wonder.
Even though I've had many arguments with your handlers (which is of course part of the job) your still people at the end of the day just doing a job and I honestly hope you all find jobs soon.0
