If it's a cheque directly from drive assist, tpi would have already paid out directly to drive assist. Under FSA regulations any money held on behalf of the client DA should put in another account. The administration process has put a hold on all accounts so to get your money back from drive assist I'd imagine it would take a while. You can try contact tpi yourself explain the situation and make them aware that you have not been returned back into the same position that you were in prior to your accident ( they are obliged to do this ) they may pay you themselves and claim back their money from drive assist. If you do it this way they may actually say that they have done what they are obliged to. Next step would be to contact your own insurance company and see what they can do. A possible outcome would be they allow you to make a claim on your own policy and they pay you out directly, this will be a claim on your insurance and your excess will be deduced from your settlement. Your insurers will then chase tpi for reimbursement. Tpi will then have your insurers on their back which would hopefully make them chase drive assist for their money back which they will use to give back to your insurers. Once your policy has been reimbursed you will have your excess given back to you. You will need to ask ur insurers whether this way would permanent affect ur policy ( some company say it does some don't ) your underwriters or broker may show you some sympathy as they were the ones who referred you. finally, if you have legal cover which will be labelled ULR cover you may be able to ask them to chase tpi for another cheque and let tpi worry about getting the other money back. All of these are only suggestions that you may want to have a look at, however I do have a feeling your only option that will get you your money back will be to claim back your money directly from DA look up FSA regulations for holding client money but it's worth checking out the other options.

I can tell you myself. Drive Assist has gone into administration. No matter what money they put into it, it cannot be saved. Drive Assist is no more.
Source: worked there for 4 years.
  • Oh dear where does that place me I wonder then. Someone drove into the back of my car on 19th November and I have a hire car from DA. My own car is a write off. As I only had third party fire and theft on my car my insurance company would not deal with me - reason I went with DA. I have asked them to collect hire car on Wednesday as I am leaving the country. I suppose I will have to deal with other insurance company direct to get money back for my claim. Any further information or advice would be greatly appreciated.

Would have to say all staff I dealt with there were very professional and empathetic - I hope they will be ok

  • My experience was very different as I'm with Esure I was told one thing by on staff member then totally different story the next day
Left hand don't no what the right hand was doing.....
And today who ever answer the phone at 9:30am was so rude to me when I asked what/how they would resolve my rubber cheque
I was told that they where under instruction not to put my call though to there finance or to any managers

None of the call centre staff knew that the company was under administration until about 5pm. Each query that came in
, was referred and the staff were told different answers which were relayed to clients. As management weren't given staff the full information this will be why you experienced different/wring information.

Bluecelticgirl - you would need to contact the other drivers insurance yourself now. Virtually your only option. Good luck
