Claiming Charges from Argos Card

I bought something from argos at the start of the year 3 times they attempted to take money from my account but i had no funds to cover it. Argos promptly charged me £35 each time. My question is, can i claim this money back as unlawful charges as most people here are doing against the banks, and if so how do i go about it. i am currently in the middle of a claim against Barclays. do i proceed against Argos the same way?

Thanks in advance fellow MSE's

Yes, it sounds like a penalty charge, so start the procedure.

Just rang them, ha. The b*****s charged us over a 3p oversight a few years ago. Will be getting that back me things.

They couldn't give me full details as it's in hubby's name so we have to write.

Can any clever people sketch out an opening gambit to send.

Just found this over on the Consumer Action Group.

Mods if I'm not allowed to post this in full please feel free to delete and leave this link in its place. Thanks. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/586-credit-store-card-letter.html

    LETTER BEFORE ACTION

    Dear Sir/Madam,

    CARD/ACCOUNT NUMBER: xxxxxxxxx

I now understand that the regime of fees which you have been applying to my account in relation to late fees and over limit charges, are unlawful at Common Law, Statute and recent Consumer regulations.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.

I calculate that you have taken £XXXXX plus £XXX which you have charged me in interest for the sums which you have taken. Total £XXXXX

In addition to full payment of the sum mentioned above, I require that you remove any default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable.

I require repayment in full of this money. If you do not comply fully within 14 days, I shall begin a claim against you for the full amount plus interest, plus my costs, without further notice.

    Yours faithfully,

    [name]

You can add this if you have received a default notice from them.

'Additionally, you have entered a default notice against my credit record. This default occurred merely in respect of unlawful charges levied by you, or was the result of impecuniosity caused directly by the taking by you of penalty charges which you had applied unlawfully to my account.

In addition to full payment of the sum mentioned above, I require that you remove the default entry from the register. Please note that mere correction or amendment to the entry will not be acceptable.'

  • Hi all.

Received my statement history from Argos today, but am a bit confused by it. On the left, it tells me what the money in the column refers to..

    Purchase
    Payments
    Fin Chgs
    Other DB
    Other CR
    Returns

What do the two above in bold refer to charges wise?

    Fin Chg = interest?
Other DB = i can claim all of

    Thanks

  • I've merged this with an old thread regarding Argos as someone else might know what the abbreviations stand for but as always if you don't know phone up and ask! You can't claim for interest.
