Matt a lot has changed is changing, the advice adapts to that. We have pofa 2012, popla, 100% success rates at appeals there, ppcs becoming more litigant , and tactics changing when it's neededWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Matt.
It changed over a year ago with POFA 2102 so you won't find a summary now, as we are completely into the current advice here as it's not a recent change at all. POFA 2012 was discussed in 2011 and 2012 (so it's old news that the registered keeper can be liable) and then PE started to sue people in 2013 so we changed our advice to suit, again this was many months ago. I have been advising people to appeal and use POPLA since around Christmas 2012 in fact - well before PE started getting litigious - because I felt it was important we learned what wins at POPLA - and we have learnt!
That's why every thread talks about 'appeal and then win at POPLA'. That's why there's a sticky thread talking about POPLA decisions (read the most recent posts) and a thread about successful complaints to landowners which also works a treat!
Umkomaas' walk-through reply is a nice summary:

Interesting also is the wording on DRP first two letters;
They both refer to "the landholders solicitor" for pursuing any court action.
How misleading and misrepresentation of their client is that....?
I doubt very much if Total Parking Solutions are the landholder and even less likely is DRP acting for the landholder. This even suggests that Total Parking Solutions do NOT have any legal right to pursue charges either.:):)0 -

I see that there is some difference between windscreen and non-windscreen routes. I do not find your post clear in this regard - is there really a difference?
Am I reading correctly that the advice is now not to ignore the letters and to challenge in writing as the Keeper once the NTK arrives?
Is the "Charge Notice" posted above the same as a NTK?
Cheers
Matt.
I refer you to Stroma's post #55 - if you do even the most basic of reading of the most recent threads, answers to all of your questions will be evident.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
