    I'd say the Tribunal date is just coincidence for an appeal already in the system and that the reconsideration would still go ahead. Otherwise they'd be misleading the MP.

    The 21st Dec could just be some kind of target issue - claims cleared in X days, reconsiderations done in Y days, that sort of thing.

    So it might be done quicker. Sorry, can't help with the other question....it's after my time. I do remember that different health issues or a significant change was okay for trying again, but maybe not for non attendance at a medical.

    I'd suggest you make a separate thread on that so the question is seen or pm someone like benefitbaby or rogerblack

    Phoned MP they said that the letter was probably automated HM courts and Tribunals different to DWP and i will here off the DWP this week.
    Phew!
    I think i will wait till the end of the week now.
    And to reply to crabyducky the local sorting office have flagged my address on the sorting stand for the post office temps so hopefully post should be ok now.

    And to add if it helps others i have been given a foodbank voucher today off my MP and will have 2 more to last till after Christmas, they are supposed to last a week.

    Yes you can make a new claim -as I said in post #26-
    *If it is the same condition....
    then you have to wait without pay until an assessment has taken place.

    *If it is a significantly worsened condition and it says so on the sick note. OR
    *If it is a different condition.......
    then the new claim will go to a DM to decide whether to pay out on the new claim. Which could take weeks to decide.

    Well to finalize this thread.
    I have had a phone call off my MP with so very good news DWP has revised the decision and its in my favour. They say i will have all moneys backdated but will take about 5-7 days to sort out. I am so happy i hope that this thread helps people in my circumstances. If it was not for my MP's help i know i would have not got anywhere.
    I do really believe that your local MP can help you if you are stuck in the position i was.
    Thank you all for your words of encouragement that helped me carry on.
    And i wish you all a VERY MERRY CHRISTMAS.

  • Just goes to show doesn't it... the threat of higher authorities. I waited 6 weeks and made 2 complaints about my council not cleaning some graffiti off my wall. I decided to CC in my local councillor and within 30 minutes there were council officials inspecting my wall... as I watched them a call came through assuring me things would be resolved... and shortly after I got an apologetic email from the councillor who insisted she would personally ensure the matter was dealt with and that someone would personally speak to me in person to confirm the removal. 24 hours later all was done.

    But pleased you got this resolved... you were completely victimised for no fault of your own.

    Where opinion, 'reasonableness' etc is involved, an MP makes a hell of a difference - even if the MP is not that good constituency-wise.

    In DWP/DSS I always found councillors didn't get the same respect. "She's just a Councillor" was the response from a manager of mine. An MP letter went directly to managers unopened. A councillor's letter just went in the ordinary mail with managers not even wanting to know.

    Maybe it has more weight with the council. :)
