    The OP doesn't say whether Argyle Court is a single dwelling or a block of flats.

    If a block of flats, then you would also expect the individual flats to have their own numbers.
    EG

    7, Argyle Court, 17 The Street, Cardiff, CF5 5SS

    This needs to be sorted out by the Council/ the Post Office?

    Presumably the Council can differentiate for purposes of Council Tax etc?


    Hi they are both blocks of flats. i live in say 7 the street cf5 5ss the other flats at the end of my street are, the street, argyle court cf5 5ss both with same numbers

    So are items being mis delivered as addressed to you,but delivered to Argyle court?
    Or is it a case of items being misaddressed?

    I think they are. I cannot find out if my letter has gone there as nobody lives at that address but my neighbours have mail and other thing delivered to them when its for the other address, and vice versa.

    should sort it out? Ask the Council to write the the tenants explaining how to record their addresses?

    I think you can under pressure (possibly from an MP) ask for a second reconsideration. A reconsideration (esp one with an MPs letter behind it) is going to be done much quicker than a tribunal.


    If I were you I would get all the evidence you can of
    • What exact address do ESA BC hold on file for you (you may get trouble getting the ESA telephone agent reading this out to you, they will ask you security questions first, but then once you have passed they will ask you for your address and then they will say (hopefully) "yes that is what we have" but ask them to confirm it is exactly as you say of course what they have will also be on the letters they send to you....so if you keep all your letters you will have a record if it was ever wrong)
    • What exact address does ATOS hold on file for you 0800 2888777 option 3
    • Witness letters from neighbours about problems with post
    • Police report for the stolen mercedes
    • Letter from Royal Mail to acknowledge they are aware of the problem, and to include how many complaints they have had about the problem for these addresses.
    • How many times did you phone ESA & ATOS about missing post or post with wrong address and/or had to ask them to correct the address and ask ESA/ATOS to verify these calls you made from their notes on their computers. It would help initially if you knew the rough dates of when you made those calls.
    • What you wrote in post #1 & #4

    I would put all that together and send it in a bundle to the ESA BC (recorded delivery) and state in the letter that this is being CC'd to your MP. Send a copy to my MP with my ESA BCs address, and tell the MP (and your ESA BC) that you are suicidal having £0.00 to live on and that you cannot wait for the tribunal and request the MP to intervene to request a second reconsideration.

    Another thing....Have you made a new claim? If you did a new claim you would have a WCA usually within 13 weeks and they might speed that up for you. Then if you subsequently fail the WCA...I don't know if you can be paid on appeal but you will find out soon enough.

    mine is say

    Cardiff

    The other is

    you will always have problems with your mail on this type of set up
  • argh! Nightmare! Sorry to hear of your struggles...can you not go on the assessment rate of ESA whilst you appeal? If you supply medical fit notes from your Doc I thought you can claim the ESA assessment rate which is £70 per week or something like that...

    No i cannot go on that rate as it is a missed medical examination. I am entitled to £0.00. If i failed my medical then i can appeal and go on that rate. :mad: The sanction for a genuine not receipt of appointment letter is disgusting. My illness is getting much more worse because of this i just hope i can hold on till the outcome.

    Will i get all my benefit backdated from when they stopped it if it goes in my favour?
