have not had anything more paid into bank, rang them, they said i had to wait until i received letter confirming payment. then i can see what they have repaid. from the looks of it is about £120 short (which is mostly interest). i am not giving up, baby needs a new car seat soon!!!!!!!!!0 -
Hi all,
I am going down the route of claiming via my local county court and not MCOL.
The thing I've found is that there is no 'How To' guides on any of the threads about how to fill in your forms... I have looked and looked and have found snippets here and there but no one place where a simple check list, how to guide is, so anyone claiming can go to and see without having to trawl through the forum..
Now yes I know there is a thread on what and where, but it does not include, How to fill in the N1 form....Easy enough I hear you say, but I even made a mistake on it and had to dash back over to the courts ,(10 mile round trip), because by the time I got home I suddenly thought, Oh no I've put the wrong amount in the particulars of claim, part 4 interest..... Easy enough to do in a big queue of people..But never the less I still made a mistake, which could have been disastrous had I not realised...
Now down to the reason of this post... I am claiming against Halifax, and the time runs out today, (17th), and I am going over the form for entering judgement by default... I will ring the courts today, last thing, just to check that a reply/defence has not been made as yet, then I intend to get to the courts first thing tomorrow morning to get the paperwork in...
Now, if anyone has or is doing the form then could you help me out PLEASE...
I am ok with the A and B check boxes, my problem is the amounts part...
1. The amount of claim as stated in claim form,(inc interest at date of issue).
I am ok with that as it is the total amount of claim amount + interest as on total in N1 form...
2.Interest since date of claim (if any)........
Now this one I'm not sure of...Do I try and work out the interest or just not bother....
3. Period from... to....
This would be date of issue to the date forms to be handed in, (18th in my case, being the day after deadline to reply has passed).
4. rate...
This also is a confusing one as, is it 8% per annum or amount of interest from form N1 accruing at 0.021% per day...And if so how is this worked out...
5. court fees shown on claim...
Now if your like me and on benefit, this is left blank???
6. Solicitor's costs (if any) on issuing claim...
None as doing it for myself...
7.SUB TOTAL...
Easy enough, all above amounts added up...
8.Solicitor's costs (if any) on entering judgement...
Again nil due to doing it for myself...
9.SUB TOTAL..
Same as previous sub total to be entered I guess??
10.Deduct amount (if any) paid since issue...
Self explanatory...
11. Amount payable by defendant...
Grand total of all above...
If anyone can advise as to the areas of concern I would be very grateful as I have until tomorrow to sort this out and will have to ditch any other amounts apart from the total on the N1 form..
And if any of the site moderators are reading this.....even the ones I personally messaged about the form issue...Maybe you will put up a 'forms for dummies thread'. Just to help out people like me, a little nervous and not 100% financially 'in the know'....

Well I am in the same boat as you! I handed in my request for judgement on 9th May as Lloyds didnt bother to acknowledge it.
Unfortunatley i didnt take a copy of the request before i handed it in but will do my best to answer.
interest since claim
I had peviously downloaded an interest calculator from CAG website which i saved to my PC and updates itself every day. But if i hadnt I would have used the interest calculator on this site and re-enter all the charges then subtract the total that you put on your N1 form eg:
re-calculated charges plus interest 1015.00
N1 form total (including interest) 1000.00
= 15.00 interest since date of claim.
Rate
I put in 8% per annum
All the other points are as you have descibed them.

Just got off the phone to the county court...
The Halifax have entered a reply yesterday....
And the funny thing is that I received the Sorry about your recent complaint but you agreed to the T&C's on the account so they were applied accordingly bla, bla, bla letter yesterday..
But I thought they had just followed up there 8 weeks to sort out letter...
Turns out they have entered a reply,(not a defence as yet), and they have until 31st to file a defence, and they have there HBOS legal team/solicitor on it...so fingers crossed...

Hi all, lloyds have acknowledged. They now have till 30th to enter their defence. I knew they would but a tiny tiny bit of me was hoping they would forget about me.

A quick update on how my claim is going.
13th April file claim at cort
8th May papers deemed served
9th May file judgement request as lloyds didnt acknowledge
19th May judgement request returned to me to amend or explain why amounts claimed are different on claim form ( £4714.00 just charges as i thought court awarded the interest) and Judgement request ( £5322.83 charges+ interest+ interest between claim date and judgement date)
It seems i messed up somewhere along the way, but i will get solicitor friend to have a look before i do anything else.0 -
Nationwide have until Friday (25th) to put up a defence, nothing gone into my account yet....Watch this space 5 days to go and counting0

still nothing for me have checked my accounts but nothing as yet they have 8 days left0 -
well i have posted letter drafted by solicitor friend to explain discrepancy of amounts on N1 form and judgment request.
So the waiting goes on for me.
