Isn't it a shame no provisions have been made for costs? This means a justifiable grievance cannot be pursued and the company made to pay or their incompetence.
I got £100 from Glasgow City Council for not cancelling their ticket on a initial appeal, waiting until the Parking Adjudicator got involved. True, this wasn't private parking - but if it is good enough for one, it's good enough for the other.0 -
I think IF the victim appeals to the PPC on one appeal point and to POPLA on another it would be difficult for POPLA to side with the victim as the appeals differ surely? I think you will need to appeal to the PPC on all aspects and then send POPLA the whole appeal you sent to the PPC with a covering letter stating the chain of events. :idea:
Who knows for sure - the website does not mention it so I would say they would not expect anyone to appeal on different grounds to them as apposed the PPC.....0 -
Why ? if you make a defence on a small claim you are not just restricted to that one thing. If you make an appeal to patas you can add further details from the council appeal you make. Plus other things may change from what you said to the parking company to a popla appeal.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

But that's exactly what happens all the time with real PATAS and other local adjudication appeals in the real world with Council tickets.
Understandably, people fire off a naive, desperate knee-jerk first appeal and then when rejected by a Council, they do some internet digging and maybe take advice from a forum like pepipoo if they are smart. Then in the end the final PATAS appeal bears no relation to the original one whatsoever.
And PATAS do not have a problem with that so why should POPLA? It's human nature.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

100% agree that is what happens and my concern is POPLA may not take this into account - IF they have BPA members adjudicating appeals. Only time will tell I suppose....0 -
