That's a very good idea. Thank you. How do I make the courts aware of such things? I understand I have to provide a Statement of Truth. In other words the same thing I wrote when the court process first started. This will be accompanied by a set of pictures and documents I might wish to rely upon at the hearing to support my case. These and the statement get sent to all parties, including the court at least two weeks before the hearing.
How would I make the court aware of these cases as you suggest?

Why too late? I have warned them its all viewed as harassment right from date the first letter arrived but they have continued and I must respond to avoid a judgement against me.
Surely the point to sue for harassment is when it has run its course. That would be after the hearing date would it not?

Build in to a covering letter with your defence. Here's more information, but note that the original hearing date was postponed after a crank-caller caused some problems. The revised date is somewhat of a 'secret' because of the intense interest in the outcome.

If I read these correctly the PE mass hearing might have passed? Any word on this. Well past March which is when one stayed case was said to be going ahead. Last thing I wish to do is get the judge interested to then find its over and was a damp squid in the end.

You had an opportunity to counter sue them when you said you were defending this claim, what I meant was that you can't do that now I think. There is nothing stopping you making a new claim for harassment though.

So what I said was true, the only way you can make sure the claim cannot be dropped is too counter sue. Maybe one of the more experienced people will comment on this as I am not 100% sure.

This has definitely NOT passed. It's outcome will be all over every parking forum like a rash once the case has been heard.

Don't go worrying about any damp squid (or even squib!). All squid is damp (until it hits the frying pan )

I have been told PE provide two additional pictures of your vehicle in the evidence sent to the court. Anyone know what they are and why? I know the site in question here has two cameras side by side at the in. And again two cameras side by side at the out. The original pictures they sent me looked to have the plate digitally enhanced. Characters cleaner than in real life and the plate not quite at the same angle it is actually mounted on the car. Don't tell me the pictures they get you to pay up on or go to court on are not real pictures!!!

op - I'm late into this one and not one of the long-time experts, but some of your mindset and anxiety chimed with me, but only at the start. You have grown in knowledge now, but your mindset still lags and seems to buy into Scumpany's agenda. Focussing ire on other causes[ viz Highways Agency]can come later.

That's when you can involve local journos etc and have so much the stronger case: 'As someone who took on this Scumpany and won...etc.etc blahblah'.

Now, apart from a dramatic episode today[stromboid poisoning[no and no, I'd never heard of it either], I have now received 2 POPLA decision ems: 2 successes against the scumpany known and universally loathed as pe for end Nov/start Dec. 2013.

I intend invoicing them for costs - material, time, stress, harassment and making BPA and DVLA further aware, as per c-m #3 of her NEWBIES THREAD.
'WHEN you win at POPLA, send a complaint afterwards to the DVLA by email that the PPC is in breach of the "KADOE contract" by virtue of whatever the POPLA decision was based on: http://forums.moneysavingexpert.com/....php?t=4890308 The more pressure on the DVLA the better.'

This is one way of re-paying, in tiny measure, all the help and support we've had here.

That pivotal Case is in Cambridge, near Fens-y me. I was waiting to support the group that day. I actually looked forward to my 2 'parking events' going to Court, being publicly blitzed. Have you actually made The Parking Prankster aware of your unfinished business yet? It's been advised several times already. You must do this.

While I understand your initial standpoint, I totally agree with others who feel you have become over-emotional, fog-bound, sometimes advice-resistant to the simple, proven route offered for every stage, including the one you have allowed this to progress to.

That doesn't matter, but I urge you to relish this opportunity to give pe another drubbing, and Capita Finance who thought they'd snaffled the goose that lays golden eggs eternally.
Their credit rating has plunged. Be part of making it drop further.

The guy who thinks he has this automated money printing machine running like clockwork needs a serious wake up call.

After eighteen months this has almost run its course. Eighteen months of harassment in very much the form I predicted. Done every sensible thing within my power to get them off my back. SIX harassing letters from PE and FIVE much the same from the Small Claims Track of the County Court. All this for something I did not do.


STAY OUT OF ANY CAR PARK YOU SEE WHERE PARKING EYE OPERATE.


For that matter any that show cameras and signs saying you enter into a contract with someone. Otherwise you stand a chance of going through the exact same process.


Write or tell the store managers or owner of any business you use in the area face to face that you will no longer be conducting your business with them until the parking scheme is changed. There are thousands of these flawed pieces of evidence in support of groundless and fraudulent claims for your hard earned money submitted to the County Courts every week by these companies. One day it will cost you £50 or more and then at least another £200 to fight them, with another £150 to pay if you lost in court. And you will most likely lose because the only evidence is held by them. Their template papers sent to the court are stacked against you. Big holes in the family grocery bill you will never recover no matter how you shop. Tell them you are going to their competition. The retailers have the power to tell the land owners to stop the fraudulent parking schemes.


This works much like the National Lottery but in reverse. Not long before your own number (that's registration number) could be up in the wrong sort of lottery. Might be this week or next year but the odds are too high to risk. The cost to you is high while the lottery is won every day by the car park operators who extort lottery size wins out of your very own pocket. They trick you out millions every day.


Now someone else I know has a fake charge sent to them. This for riding a motor cycle through one of these car parks. Even though it does not display a number plate to the front and one of the cameras there relies on this as indication you went in or out??? A young person just starting out in the world of work and driving, the hole in their petrol budget for the year will put them off the road. Which means they do not get to work, which means they have no means to pay.
