Thanks. What do pepipoo.com do?
Hoped there might be some can give the benefit of their experience over here too.0 -
Just to say there are loads of similar court cases threads on pepipoo with advice and links already supplied to people. It will help you to read every court thread you can see here on the pepipoo forum below, go back at least 10 pages and read the advice given (ONLY on PE court threads, don't get bogged down on any others). You will see the same sort of letters sent to all victims by PE at this stage and you are best to respond to them robustly (just a letter, not via the court) IMHO. You'll learn how to deal with this from the pepipoo threads:
http://forums.pepipoo.com/index.php?showforum=60
Also read these links which are essential info IMHO:
Advice: Small Claims & PPCs
List of PPC Court Cases (non-exhaustive)
and email the Parking Prankster asap (he posts on here sometimes too):
http://parking-prankster.blogspot.co.uk/2013/11/do-you-have-court-hearing-with.html
and if it was at the Range or Aldi then there's specific info about them in his Oct/Nov/Dec blogs on the right. Read them anyway even if it wasn't Aldi or the Range, and read all the recent PE shenanigans in the pepipoo threads too, you'll see there's a bigger picture to defending this than you'd think.

Thanks for that Coupon-mad. A plan of further defence I will follow up on0

""No need in the end. Their senior parking officer explained the confusion in that area because Google Maps shows a street and name where there is no street. They confirmed where I did park was definitely a public street in their pay and display bays.""
I don't understand your problem. What more defence do you need than the above? PE don't do council parking.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
Just a thought - if there's ANPRS of you going into the car park but not coming out, they have to concede that either your car is *still* in the car park, or they admit that their system failed to register you leaving when you did and so their claim is both groundless and impossible to prove.0

Nearly that but to clarify.
Their two pictures and only two pictures show me going in at one entrance. And later going in at another entrance. They don't provide a picture of me coming out at all. Unless of course I was in reverse in one of them??? Focus is a bit quick at times but does not fly.
Pictures staring them in the face but they just can't see it. I asked for further enlarged copies of the pictures to use in my defence. They supplied them and I explained again and in different words.0 -

Wow! Yours is one that the Parking Prankster would be interested in!
And one for you to sue them over if they don't pay your Personal Costs Notification ('PCN') after this is over. They've wasted your time utterly. Read this:

You can do that too. Was it also a Range or Aldi car park, to add the icing on the cake as far as complaints go? You could add the store/landowner in as liable for your costs too, that would put the cat among the pigeons.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The psychological mind clamping continues. After one and a half years of clerical mind torture by Parking Eye, this case will go the County Court within the next month.
If its supposed to be a process designed in the name of a freedom act then I can assure you it is anything but freedom. Its the equivalent of wheel clamping but by clerical torture as its purely a written process. Unlike wheel clamping its invisible so no one knows how much of it is going on. The number of cases is not limited by the number of clamps you can get on and off in a day. Many cases can run concurrently and all based on ANPR systems that can't recognise a plate obscured by pedestrians or other vehicles. Only time you get to speak is in the court. How many people have the stomach and time for that? Many a time I thought about throwing the towel in and paying just to get them off my back.
And you must prepare for the court and get your papers in two weeks before the hearing. Yet the claimant has the right to pull the case just seven days before the court date without suffering any additional expense (get their hearing fee refunded). This after they had time to study your final defence. Hence you do the work to defend but might still not get your day in the court. Surely this is wrong? How do we make certain they don't pull the case?0 -
By counter suing for harassment maybe? Though I think it's to late for thatWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

You might want to make the court aware that there is a major review of a large number of PE cases (which have all been 'stayed' pending this review) in the South East of England. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
