    "(3) The payer may withdraw its consent to a payment transaction at any time before the point at which the payment order can no longer be revoked under regulation 67."

    To summarise, it's saying that if you're too close to the time of the agreed transfer, or after the money has already gone, you can't revoke permission.

    If you're days or weeks before the transfer taking place (or there is no agreed date), you can withdraw consent.

    Banks aren't above the law :)

    If you quote the law in your letter, then if the person reading it doesn't understand they should hopefully have the sense to pass it onto somebody who does!

    Thank you so much! I did this over a week before any moneys were due to be taken, as at that point I was considering a dmp. But the bank just said no and let them take the money :(
    I decided against the dmp as I wanted to have my accounts settled asap, so now I am in control of my finances again and have all accounts settled. Its just these parasites that are being a massive pain in the backside!!

    It's a bit frustrating because there's no way of getting instant results if the bank flat out refuses to help and obey the law, but if you make a complaint, first to the bank and then to the Ombudsman in eight weeks time (if the bank don't deal with your complaint appropriately), you should be entitled to some compensation - as long as you have a copy of the letter and proof of postage so you can show you did ask the bank to stop the payment.

    Arrgghh! Here we go again with emails from NDR, non of them replying to my offer of paying 282. I'm getting really annoyed now. Where can I send the money without entering my card details?

    Do you have their bank details? You could send them a faster payment.

    If not, maybe send them a cheque?

    Never heard of Toothfairy Finance passing a debt onto anyone but their own in house companies; Northern Debt Recovery or Marshall Hoares 'Bailiffs' (:rotfl:).

    Once she has paid them what they're legally entitled to I don't think they can even sell on the remainder that is made up of illegal charges can they?

    No they won't give any bank details apparently. I have but the bullet and paid it through their page (£282) along with a long email explaining the fact that I have been emailing them numerous times to offer this as full and final settlement. If they had sent a reply agreeing then this would have been paid sooner etc.
    I have also told them (again) that I withdraw my consent for them to debit any amount from my account and if they do that all relevant authorities will be notified.

    I will keep you updated with any response I get from them :o

    I feel sick to my stomach right now!

    They have taken £136 out of my account today! The bank said I have to wait till tomorrow to make a dispute about it. I have complained to the OFT and FOS yesterday. I am so angry. What can I do to get this money back??
