Is toothfairy finance one of these companies that the CAB are talking about?

I'm having dealings with them currently and as soon as I mentioned OFT, they began being very friendly.

Report them anyway, the OFT need as much evidence as possible.

Thank you for the reply michael!
I'll admit that they do try to scare people, but I won't let them scare me.

What would happen if their license was taken away?

Its not a case of if, its more a case of when. They will get both their credit license revoked and their license for debt collection. They will no longer be able to offer loans and the debt will have to be sold on to a debt collector that does have a license. I understand that they will be getting quite the hefty fine too :D

Oh right, which obviously they will most likely be a debt collector who will work legally.

I had asked to set up a repayment plan, however they will not accept it at all. And their debt collector has been ringing me even though my file has not been passed to them yet!!

I used to get 3 calls in one day, one from toothfairy, one from northern debt recovery and one from Marshall Hoares Bailiffs all claiming that they hold the debt and I owe them money(they are all the same company mind you) I also used to get emails that were automated at virtually the same time saying my debt has legally been assigned to northen debt recovery, I'd then get virtually the same email saying that Marshall Hoares own the debt.

The correspondance (which was always through email or phone) was often contradictoary to what had already been communicated with them in the past and appeared just to be automated generated emails of which they had no control over.

They threaten bailiff action and the intention to take goods upto 9 times the value of the debt (which is absolute rubbish as that is not what the courts enforce).

They constantly threaten doorstep visits even when you clearly revoke their license to attend your property.

Basically they are a cowboy outfit and in my opinion quite possibly could be bordering on the grounds of criminal law infringement.

Did they actually send anybody out?

If you don't mind me asking, how did you resolve your issues with them?

(Sorry I seem to be asking so many questions, I just want to resolve my problems with them asap).

They never sent anybody and I resolved the issue if you can call it that by ignoring them. I tried to negotiate with them and come to some sort of arrangement but they were never happy to do this and started adding on all sorts of charges that I disagreed with. So I told them to take me to court so we can discuss it in front of a judge and they never have.

Have you paid off your debt to them? I was thinking of giving them my repayment plan, on my terms, and setting up a standing order?

Nope the debt is still outstanding. I won't pay them a penny until I get my compensation off them that the ombudsman has awarded me for their conduct.

Have additional charges continued to be placed on your debt?

I'm worrying that they will escalate charges unreasonably if I give them a plan on my terms.
