    I've reported him to companies house for what amounts to fraudulent behaviour. All being well that should get him banned from future directorships and creditors will have a claim against his personal assets. It's the least he deserves.

    I've pointed it out before, and no doubt I'll do it again, but it's fairly common for small business to go bust and 'not bother' with any formal insolvency process. If there are no assets in the company (and I'll bet that their aren't) there's no reason for anyone to waste good money on any legal formalities. The owner will simply wait for Companies House to strike the company off when it fails to file.

    That's exactly my point...it's just assumed that there are no assets and for what they've lost it's not worth customers chasing up through small claims etc.

    I appreciate that as a country we're in recession and that enterprise should be encouraged but the flip side is that it's just all too easy for a company to set up, get the cash in, probably run up a nice big overdraft with the bank, leave suppliers with unpaid invoices and then just walk away. Only to come back several years later and do the same again.

    I think whenever I buy from companies online now I'm going to make sure that Neil alvey or neill alvey is not involved or his wife bough I can't remeber her name

  • I have no energy left to continue the battle to try for a refund any more. Halifax Bank are not interested, I can't do a Chargeback, and my only recourse now is via the Ombudsman.

    I feel beaten, and that's not sitting comfortably with me, but sometimes I think it takes all my energy just to get through a 'normal' day, and anything over and above that is just too draining. I can't afford to lose this money, equally I can't afford to allow this fight to continue to drain me like this.

    I'm sure I'm not alone in feeling like this, and I hope for all of us there will be an end to it, whether that be in the form of a refund or simply an uncomfortable acceptance that this one just has to be filed under 'The one that got away'.

    It's not easy to dissipate the anger/frustration/upset/worry etc that this has caused, but I can't afford to allow it such a dominance in my life any more.

    I'm so sorry to read this but its been a long drawn out fight and at least you did put up a fight. You went down fighting. The stress this little epitsode has caused is beyond belief. I hope you are feeling better soon xxx

    I'm afraid I've reached the "uncomfortable acceptance" stage too. Your post puts the feelings very eloquently.

    I've just got too much else going on in my life to give this any more of my time and energy.

    I'm £75 pounds down, as I received 2 of my 4 orders (they weren't as described :() and received a PayPal refund for one of them, but I'm having to look at it that I would gladly pay £75 for the worry to go away, if that makes sense.

    So, I'm giving myself permission to just let it go.

    However, I'll leave this thread now with this final message to Neil.

    I hope you never, ever get to do this to people again. I can't stop thinking about your ridiculous message on twitter before Christmas, berating people for complaining "they're only hampers".

    You not only ruined Christmas for many people, caused people a load of stress and worry, but you also damaged people's faith in small business's.

    I have absolutely no sympathy for you, when you bleat on about how this may effect your family. Your self pity is pathetic.

    You have brought this on yourself with pure greed, and I hope the suppliers and distributors, you have swindled, hound you through the courts, or even better manage to bring criminal charges against you.

  • I have recieved a letter from barclaycard saying they are crediting my account back for £144.99 temporarily. They have said that they are not responsible under section 75 as i paid through paypal. They have contacted the merchants bank on my behalf and if they do not respond they can't get involved????????? They reserve the right to charge me back if they get no response from the seller?? Doesn't really make sense?? Has any one else had this?
