  • Not sure if this is posted already but came across it on "What Consumer" in words I can understand! :

    The majority of us are now aware of the benefits of using our credit cards in terms of the protection it offers us in the event the supplier is unable to offer the goods and services we have paid for.

    But did you know that you can also claim the money back if you have paid on your Visa Debit card? And unlike your credit card, which imposes a minimum spend of £100, you can claim back any amount of money.

    The process is called Visa Debit Chargeback, and, as the name suggests, is a procedure in which the banks will ‘charge back’ the value of the original transaction directly from the supplier’s bank, and pass this amount on to you.

    All banks who issue Visa cards have only recently agreed to process chargeback requests, and there is still widespread confusion over what it is and how it works. Therefore if you meet a dead end in your discussions with bank staff, persist. The facility is there for you to take advantage of.

    Invoking the chargeback procedure

    If you suspect your card has been used fraudulently, if the goods and services you bought with your card are faulty or if they do not materialise, then you should contact the bank who has provided you with your Visa debit card within 120 days, requesting they initiate the chargeback process. It does not mean you will automatically and immediately get your money back. It will initially become a ‘dispute’ in which the claim will be fully investigated by both banks before any money is returned.

    When you make a purchase though Paypal you are not covered by section 75 of the Consumer Credit Act and therefore you cannot claim your money back from your credit card provider. However, Paypal transactions are covered by the Visa Debit Chargeback scheme.
    When you make a Paypal purchase the corresponding amount is taken from your primary payment card or current account associated with the Paypal account. This makes it straightforward to determine whether a Visa Debit Card was used for a particular transaction or not. It can be more difficult to make this link it you already had money in your Paypal account. This might be the case if you sell items on Ebay, take payments by Paypal and don’t regularly withdraw your money. However, it is still worth putting in a claim, especially if you have missed the deadline for using the Paypal dispute process or were not happy with the outcome. It is important to remember that you have 120 days to make a claim to the bank that issued the card.
  • I hadn't been able to get my head around 'chargebacks', debit cards and paypal so now I have something in writing I will go to the Halifax and wave it at them! When I asked about it the other day when I phoned about the Direct Debit Indemnity scheme, the person said she had never heard about that. I didn't pursue it at that point as I wouldn't have known what I was talking about. It makes some sense now I've read it so feel able to march in there.

    I am writing to you in connection with the purchase of [insert details] on [date] from [details of seller]. I enclose the following documentation which provides details of the transaction:
      I paid for [insert details] using my [insert supplier name] [debit] [credit] card. The total cost of [insert details] was £[insert details]. In breach of contract [insert details of the problem – see our guide to Chargeback for details of what can and can’t be claimed using chargeback]. The transaction for the purchase of [insert deatisl] was less than 120 days ago and accordingly, I am writing to request a refund of the above amounts under the Chargeback Scheme rules. I look forward to your prompt response. Yours sincerely,

    Has anyone had any luck getting any money back with a Natwest Credit Card. They've send me a form. However i'm a bit confused as to what to put on it as it's talking about not receiving goods or services. However I did receive 4 out of 24 although 2 are still sat here as I couldn't use them in the end. So effectively can I make a chargeback for 22 of them? Sorry i'm a bit confused.

    Has anyone heard any more from the conman himself? I am so disgusted with him. Those people who were sticking to their guns to say get a refund were so right. He emailed me saying the company was not going to close....From Neil

    So I didn't claim on Paypal whilst I still could.

    If anyone needs this as any proof of anything etc then PM and i'll send it to you.

    I am going to complain about him to everyone I can and I'll be plastering his name and his picture all over the internet and he can come and get me all he wants or threaten to with his pathetic threats!!

    I went against my better judgement as usually i'm so quick to be on the ball but I wanted to stop being so negative and give him a chance as a smaller ....teaches me a lesson in this instance but he's also single handedly ruined my trust in some other smaller companies now. Even if I know that's wrong I will always be wondering if they're going to fold.

  • I don't know if this will help any Lloyds TSB customers trying to arrange a debit card chargeback but a while ago I had problems with someone using my card fraudulently. When I finally managed to get through to the correct person he gave me 0870 909 0952 and 0845 300 6699 as direct lines to the debit card fraud department. I've just tried them both and they are both still working. Hope this helps and good luck (I almost bought the hampers but decided against it so I consider myself very lucky).
