Halifax and Lloyds are the same bank now so they will have the same procedures. It is wrong though if other banks are refunding through the direct debit indemnity scheme. And this is the way that Paypal told me to go.

Paypal told me the same, and at the first contact with the Halifax, they told me to go to paypal! It seems from the Trading Standards brief that it's at the discretion of the bank. Let's find out what banks are better than others now!

NHCo aside, this whole saga has been a bit of an eye-opener as far as protection when paying for goods is concerned. Although I have got my money back from PayPal on this occasion, I was unaware of the 45 day rule. I paid for airline tickets a couple of months ago via PayPal, with funds from my credit card, thinking I'd be covered by both if the airline went bust - by the looks of things I'd be covered by neither!

I remember....you were constantly posting and warning us. Then the majority of us were dismissing what you were saying. If only we had listened to your advice....

You're right....this was planned from day 1. It infuriates me to think that I was talking to this man a few months ago and he was lying at the time.

The series of catastrophic 'errors' during the past few weeks point towards all this being deliberate.

I'd trust an amoeba with £120 of my money rather than Neil.
Have you done a director search on him to see if he has done things like this before?

"RE: The Norfolk Hamper Company Limited

    OUR REF: XX/XXXX/XXXX

Thank you for your complaint dated 23rd January 2013

We will be considering your complaint and will then decide whether to carry out a formal investigation. As part of that consideration we may contact you to seek more information.

If you are complaining about a company which is subject to formal insolvency proceedings – that is, administrative receivership, administration or creditors voluntary liquidation – you may, separately, wish to consider bringing your complaint to the attention of the responsible Insolvency Practitioner(s).

For the investigative process to be effective it is essential to maintain confidentiality at all stages, and therefore we cannot advise you of the outcome of your complaint. The commercial sensitivity surrounding inquiries by this department into trading companies means that we must be extremely careful not to prejudice a business by revealing in advance what action, if any, we propose to take in response to any complaint that we receive.

It is also often the case that the most appropriate authority to approach in the first instance is the local trading standards office, and you may wish to consider doing that if you have not already done so.

One possible outcome of our investigations is that the company complained about may be wound up by the court on the petition of this department. In that event there is quite often some publicity surrounding the matter, particularly in the local area.

You can review our guidance online at:

    http://www.bis.gov.uk/insolvency/Companies/company-investigation/how-do-I-complain-about-a-company

Thank you for bringing this matter to our attention. "

Thanks for the link, the one I used ignored my complaint and just confirmed that there were no insolvency proceedings registered. I will resubmit over the weekend using the proper form and would encourage others to do the same! :)

Well, Iv just phoned Coop bank as my money was not refunded, and they said that it did not fall within the realms of the Direct Debit Indemnity Scheme rules. Quell surprise I suppose :(

So I will now chase up and go for a Visa Dispute and print off all my emails etc and see if I can get a refund via this route, as when I paid through Paypal, this was the card that was used and so think it would be a valid claim etc.

Will let you know any update, will now have to go and sort out getting the printer to work so I can print off all those emails :( Grrrr. Lady on the phone said that it is worth trying, and to include as much info as I can, so we shall see eh!
  • Got his attention too judging by the comments.

These sites may be of help for people struggling to get refunds sorted out, they offer advice on consumer rights. The first is already aware of the NHC as it is mentioned in their Consumer News section.

  • What banks have folk tried regarding the Direct Debit Indemnity scheme? I've tried Halifax, someone else on here has too, and the Co-op has been tried. Any others? Would be interesting to know about other banks.
