    Ok, I will try to convey what I've found out today.

    I have spoken to the Insolvency Service and there ARE NO INSOLVENCY PROCEEDINGS against this company. Insolvency ran some searches, including Companies House and The London Gazette, and no steps have been taken against him, and he has taken no steps to declare himself insolvent either. Effectively he is still trading, he has NOT OFFICIALLY CEASED TRADING.

    I spoke to Citizens advice, and because he is still officially trading, we can still pursue him for refunds. I know we are unlikely to get anywhere but this is the advice from Citizens Advice after relaying my information from the Insolvency Service :

    Write to NHCo, send recorded delivery and keep a copy. State that NHCo are in breach of contract as they never sent the goods described by the date given. State that any substitutes are not sufficient. State you are now cancelling and expect a refund. Choose either 7 or 10 days, and state that you expect a refund within that time. Give him a specific date in your letter.

    I was advised to also say to him that i have spoken to the Insolvency Service and am aware that he is still trading.

    Whatever I hear/don't hear within my 7/10 days, Citizens Advice have said for me to contact them at the end of that time to advice what the next step is.

    I'm off to do my letter and get to the Post Office. I'm going for 7 days rather than 10.
    This may or may not produce results, but it's something we can do, and I don't have the luxury of doing nothing, same as all/most of us.

    This is a very good post and your only outlay at the moment is the cost of recorded delivery.But i have a horrible feeling that because i think this was hes plan from day one he wont have any assets in hes name.which means even if he was taken to court etc and eventually makes himself bankrupt no one will get their money back.
  • Well my letter has been posted recorded delivery. £1.55 to send. I can check on line or can phone in about 5 days to check its been signed for. Stated I expect a cheque on or before 30th January.
    Now to catch that pig flying overhead............

    I don't want to be pessimistic, but just to say that I did exactly this in December and had no acknowledgement/response whatsoever :(:mad:.

    Did you follow it up with Citizens Advice or any other body? Anything else said/done?

    i am also with the halifax i called them they where not very helpful but i went into a branch and was told they would refund me in the next few days that was thursday but it is not in my bank yet will keep you all updated if the money appears
  • I haven't had the email from the company saying it has ceased trading. If I hadn't looked in on here today I would not have known, so thank you all for posting.
    I feel for all those who do not know about MSE and may not know whats happening, and may have no idea what to do even if they have heard. As I've said before, at least we have the support of one another. Others are even more vulnerable. To have lost the money and be feeling upset, angry and alone is horrible.

    yes they have he has closed the company though it doesnt look like it has went through proper insolvency yet

    I also got 2 of the monthly deals in November - 12 of which I got in December to give to a hostel which were advocate baskets and the first monthly one which I choose as chilli so I still have 11 months worth of hampers over the course of 2013 to come.
