which hampers should they have been
how man were u waiting for before xmas
were they ones which u could have atleast used???

I ordered 30 hampers in total, this was a small box so I think the festive deal was in there, which was he 2 x Christmas hampers, 2 x galaxy hampers and the 2 x just add cheese hampers.

Yes, I could have eaten them all, but they were all ordered as xmas presents and so have gone and replaced as many as I could.

I was also waiting for another 12 to be delivered by 14th/21st (whatever date Neil decided in the end lol ) as these were presents for my work colleagues, who I also went and purchased for last Saturday, and so it was all pretty pointless me accepting any delivery, as could not find any use for them at all now :(

Some were promised by 14th, as I had to send onto Ireland and also take some when I went and saw family etc, if I were to send them now, then they would not arrive until the new year, and this to me is not on, hence the refusal :(

how strange is that just had the local newspaper ring me up for a update ;)

Did you give them the "full" update, hope you did !!
Ie twitter been taken down, website changed and still no replies or refunds given, still a lot of hampers not received etc!!

But hey, he will have some back now I have refused my small delivery, so perhaps he can resend out to someone who wants them !!

    totally fair enough
problem is you could have used the 6 urself but the 12 would have been no good but u would have had no way of telling what was in the box without acepting it

    well here goes
this is such a shame that this didnt turn up before christmas
    i recieved
2 just cheese each came boxed seperate 1 has a slight tear in the covering
2 galaxy in wicker boxes not had a good look inside
1 christmas pudding a slab of friut cake (no icing) very small jar of jam and lemon curd and 2 packets of shortcake fingers feels like 4 fingers in a pack this came in a wicker basket
also got the same in a small box with a ribbon on it

How absolutely ridiculous to post it on Christmas Eve - even a child would realise that for Christmas gifts and goods to arrive on 27th/28th/29th Dec is just stupid.

I hope Neil likes cake as I can imaging if he flung everything out at the last minute that it will be flung straight back to him!! Just sheer madness!

I think you did the right thing, I would have sent right back too. Fingers crossed you get your money really soon :)

If I had accepted delivery then I would have been deemed to accept the contract, although I was tempted to the way I see it is if he puts that tracking into my Paypal claim etc, then they will say he has fulfilled it etc.

The goods would probably be not what was ordered, and so chasing further under a different claim would have been confusing, so I was sticking to my original claim of breach of contract.

I think he was trying to just send out as many small bits and bobs he could as then through the DSR and Paypal claims etc he could say that he tried and will sort out in the new year, as he would have fulfilled at least some of their rules.

Does that make sense?? I think he was trying to wing it basically, as usual, as then in the New Year he could just sort it out then, as we would have had a delivery "over the Christmas period" like he stated in one of his emails.

My contract was cancelled by email on 21st, and I honestly do not know when they were sent out, couldn't see the box before it was whipped away, but if they were sent next day delivery, then they should have arrived on 24th, so have a feeling they were probably sent then :(

I will never know now, and just want this whole saga to end for us all, its ruined my xmas, ruined a lot of my friends and familys xmas, but we got through it.

Lesson learnt from me, that's for sure, socks and smellies next year for everyone lol !!

Just checked and I sent the email to Neil cancelling my 3 orders on 21st Dec, stating that he is in breach of contract and so cancel all orders and to process a refund immediately.

This is what I feared he had done. He deliberately ignored the cancellation emails, then sent out substandard hampers posted too late for Christmas delivery, making it harder for people to dispute and / or claim refunds. I'm beginning to think that he isn't as stupid as I thought he was.

Lovely thought hun, but cannot imagine my money being refunded soon. It will be like the hampers, you have to chase for 3 weeks to get them, then it will be shortand not the full amount there, then you will just be sat waiting and no info will be provided lol !!!

Well, looks like I will try and ring my debit card co to see if they can help, Paypal was ok for 2 orders, the festive one was out of time limit so couldn't raise anything for that £59.99 :(

Worse comes to worse, then I will follow up with small claims court in the New Year.

That's why I refused delivery, as otherwise it will be his word against mine on the substandard goods etc, and so I thought it was best to refuse totally, as my contract and emails all stated they would be by 14th Dec etc, so hope I done best thing !!

I think he knows that if he sent something then he will then have time after to try and rectify matters, where with mine hopefully they would say he has to refund as goods are not here etc.

I have no idea!! I gave up last week on this lol !!

    why am I not surprised!

and I can't see what not being at home has to do with emails - you can obviously access the web from where you are so would clearly be able to access emails as well.

When the hole gets that big you might want to consider throwing the shovel away.....

    Rebecca,

my emails come through my own webserver which is for my work. I dont have these on my phone.
The fact you are implying im digging a hole is incorrect. but you can always be a doubter. It doesnt affect me like ive said so i can just back out of the thread and leave everyone in limbo if you want?
