Dauphin is right, the T&C's are legally binding, the payment issue is irrelevant! also if you look at No. 16 it says that Dell can terminate the agreement if "you fail to pay on time". Therefore this legally binding agreement is made before money has changed hands.0

If anyone remembers the Samsung TV from Ebuyer Fiasco where a confirmation email was sent out and payment was taken, and then orders were cancelled and payments refunded, then you will realise that even legally binding contracts can be broken0 -
Ebuyers T&C's are totally different
1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us.
So for ebuyer contract is formed after payment
then ebuyers T&C also state
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
Therefore Ebuyer have this one covered and did nothing wrong in cancelling the orders.
Dells T&C's are completely different and the contract is formed when they send you the PDF, this is a legally binding contract.
Lets face it, Dell wouldnt be wasting their time trying to come up with an alternative spec unless they were legally bound to do so.0 -

Difference with Ebuyer and Dell though is Ebuyer have trading Standards in Sheffield acting as a lapdog for them to "help" them see the errors of their ways (Ebuyer laughing thier socks off), whereas Dell have honoured their mistakes...remember the 2.93 celeron with 15" TFT for £189..I doWelcome, rogerramjet.
